hi all , i have been checking the employment law at direct.gov and this basically states if YOU couldn't make it to work then yes they can ask for hours to be paid back or annual leave to be deducted or wages to be deducted :-(

HOWEVER if your place of work was closed and they had no work for you to do, but you could have made it into work then they CAN NOT do any of the above !!!!!!!!! I have also contacted acas to verify this and was basically told that if there is nothing in your contract stating that you can be 'laid of at anytime without payment ' then they have to pay you !!!!!

i have checked my contract and there is nothing like that in there !!!!!!

Hi clair, check it again-

'Your employer could suggest that you take a day of unpaid leave if you are unable to travel to work. However, unless this is included in your employment contract, they cannot force you to. Your employer must have your permission before making a deduction from your pay for unpaid leave.'


So if you cannot make it in after trying obviously then RM can take a holiday day off you (not form your statutory minimum allocation though) but cannot dock your pay - unless that's in your contract. I don't think it is???

I live literally 5 minutes from my depo they told me not to go in as there was no work for me to do so therefore they can't have anything from me :-)

IF you were happy to go in and they said don't come in they still have to pay you as per your contract and CANNOT bank your hours. That's the law if they break it take them to a tribunal and they will get a kicking.

What I really dislike is the disquiet between colleagues saying its outrageous and when a Manager tells them the money WILL be clawed back they stand there and AGREE! How can I protect these people who only really have themselves to blame (no balls)?

One colleague mentioned the thought of working for free makes them sick, the kicker is that person STARTS EARLY without pay every day! :arrrghhh

The union rep is useless, I have put my name down but I think the CWU like the idea of a Royal Mail lackey in charge of union duties TBH. I hope this is not the case but we will see.

what a day !! my manager reckons the advice i sought from acas is false HA! i've been back on to them today to double check yet again, and yes it would be classed as breach of contract !! This is really doing my head in at the mo. I know so many people in the same situation as myself have just laid back and let them take annual leave off them etc . I will however continue to fight my corner , why should i feel i can't ask for what i'm entitled to :sad:

Don`t give up - I asked to see the agreement in writing today and it appears that the Dom might have received incorrect advice and it is being looked into. Meanwhile some posties have been paying off their halfday in unpaid OT :arrrghhh Plonkers.

But when you win your case then these same plonkers will go see the Dom and get their half day back or get OT because of you :shock:

I could not get to work 3 days last week my line manager says I have to use leave. payback or SL3.
I am disabled and can not walk very far or very well on snow and ice so could not get to my local office.
Think a grievance may be lodged if he does not change his mind.
Rep says paying back the hours would be the easiest way to sort it out.

If you get more than statutory minimum holiday entitlement they can take this extra away when you cant make it in. However your disability must be taken into account and it seems unfair to employ you then disadvantage you over able bodied staff who can walk on ice. On grievence form state your disability made you unable to get in not just the weather. And why couldnt they pick you up?

I live 35 miles from the MLO and the roads where not passable. I have higher level mobility and no way can I walk far.

right i have drafted my letter arguing my case and could just do with knowing who i should forward copies to, obviously i will ask at my depo where/who
the main one should be addressed to, but just thought you guys might have some good suggestions too :nana
