Just had an email from Bob Gibson...

In line with previous years and LTB’s issued we have not agreed to any clawback arrangements.

So when the DSM tells my DOM that clawback is agreed with the union its just a downright lie, good to know these new relationships are being built on the cornerstone of bullshite!!!!!!!!

Now, although it says we have not agreed to any clawback, (yet) let's see how long it takes for the C.W.U. to come to some agreement!

These whole mess is starting to really get my goat. As I've said on another thread, we got the call not to bother coming in to the SPDO on Tuesday as there would be no mail/ work due to the weather, but that we would still get paid for the day, but owe it to RM in unpaid OT. After getting the infor from here about this not being in any agreement, I printed it out and went armed with it to work on Wednesday. I'd got told at 7.25 that morning that if I couldn't get in then I'd owe another days unpaid OT. As you can imagine, even though I got stuck 3 times and had to dig the car free, lost control of the car and got it wedged outside the spdo on the kerb and a 5 foot bank of snow (thankyou to the chap with the 4X4 who pulled me out!) I made sure I got there as I had no intention of paying back anymore hours. I then showed the printout to my colleagues. Tired to get hold of anyone either union or management to clarify the situation on Wednesday, Thursday and Friday to no avail. I'm on my long weekend now, but I just got a call from the subpostmistress telling me that if it was bad again and I was having trouble with the car (I think something may have been damaged when I got wedged on the curb) that If I could get to the main street up the road from my house on Tuesday then the mail van could give me a lift in. Whilst I was on the phone she told me that other members of staff were intending to work on SUNDAY for FREE as per the clawback of hours, to try and clear the backlog of mail and parcels! I was totally gobsmacked. If the union don't release a full on statement about the current situation with no ambiguity over whether or not RM are allowed to claw back hours in the next day before people start being forced to work free OT then everyone should cancel their subs with immediate effect.

Yep i can see them agreeing to some clawback.
Just because there is no provision doesn't mean there wont be.
Just like post above mine,its hard to get any clarification and people have already started to pay hours back at our office.
Showing the printed letter doesn't help at all.Its like the prepping of d2d story all over again.
It really feels like being a union member is a waste of money and you have to argue the toss yourself if you want anything doing.

What if they are clawing back a full day because you couldn't make it in?

I still think that they cannot take a days wage or annual leave from you. If they do this because of the weather when
its through no fault of your own then they had better not conduct me if I feel like taking the day off in the summer.
They are penalising us for snow ffs. It aint my fault so why should I suffer cos I cant get to work because roads are blocked.
I am happy to work from home. I can look out old letters, sort them and redeliver them or kill them off
I missed work on the 23rd Dec 2009 because of the snow. I got paid and I didnt lose a days annual leave so what
is so different this year????

I think that last year it was a minority of members who couldnt make it in whereas this year
it seems to have escalated and maybe RM & CWU realise the cost to the business but
and its a big but, if I fail to make it in this year and they go for a days annual leave
then I will be lobbing in a grievance and citing last years special leave paid.

I think if members can afford it...and i know that it's a big if..it would be better for members to refuse the annual leave option leaving Royal Mail no option but to deduct a day's pay..
Then i would put in a grievance citing unlawful deduction of pay and failure to take individual circumstances into account and fight it through the IR channels.
My worry is if members accept the annual leave option it will be swept under the carpet as it was with the Ash Cloud scenario in the summer.
I do however appreciate that not all members can afford to do this especially at this time of year but this is what i intend to do as i couldn't attend last Wednesday..

whether it be special leave paid, annual leave or pay deduction.
If anyone then gets hit by annual leave or loss of pay then they can take RM to a tribunal
stating other cases where special leave was paid and that they were being discriminated against.

Are you thinking forward FT or has this actually been proposed, deducting a days pay i mean.
We all know RM and lets face it a threat (as this is) will work for 80%+ of members, 90% employees, and the rest will win, but win quietly!!!!!!

On Thursday without discussing the individual circumstances of why i couldn't make it to work i was given the choice of losing a days annual leave,working my day off this week or being deducted a days pay.
Given that i believe all options basically add up to the same thing i refused options one and two and left Royal Mail with only the third option to consider.
I await to see if my pay has been abated this week...the grievance form is filled in and ready to go.

I agree totallly. There is no consistency by RM. If we all post what happens re clawback and we all have different outcomes, it will
be good for bringing a case of unfair treatment of one individual to another.
