To all Branches
As I’m sure many of you will be aware by now that our ET appeal was unsuccessful, it is now being dissected by the legal side, but having read it we clearly were not in the ET as they went along with RM.
But this is about thanking all the Branches and all your members not just for the financial support but the moral support through out the last three years. However much RM threw at us we always knew our union and our comrades where along side us. In life you expect JUSTICE but when the establishment are the ones dispensing it our chances are very limited.
We may have bent, we may have bowed but we never broke, and that is in no small part due to all of you. We will never be able to thank you enough for all your support.

TO: ALL BRANCHES
Dear Colleague
BURSLEM EMPLOYMENT TRIBUNAL HEARINGS
The CWU is very disappointed to notify Branches that the four Burslem unfair dismissal claims recently failed at the employment tribunal.
Our lawyers have explained that this was despite the fact that the tribunal concluded there were serious failings in the process followed by Royal Mail at the bullying and harassment investigation stage.
Furthermore, they explained that the judgement does not mean that our members were found guilty by the employment tribunal. The ET makes no findings in relation to guilt or innocence. They simply find that Royal Mail’s actions overall were within the bounds of reasonableness.
In conjunction with our lawyers and the members themselves, the union is currently considering the detailed findings of the tribunal as to whether there are sufficient grounds to appeal. Understandably, the views of the members concerned will be taken fully into account in our deliberations.
Everybody who has witnessed the dignified and courageous way that the Burslem members have conducted themselves in the last couple of years, will understand the depth of their personal disappointment at the decision. However, despite this our members continue to display strength in adversity that is a credit to themselves and our union. They continue to show support for their union and want us to pass on their personal thanks to everybody who has helped them and supported the campaign. For our part, we can say, on behalf of the union’s Executive Council, that we have no hesitation in restating our wholehearted support for the Burslem members because we have total conviction that they have suffered a major injustice.
It is also important to remember that when this case started there were twelve members in total who were initially suspended for a period of six months. We are in no doubt that had it not been for the solidarity of the Burslem membership and support from the wider union, then seven of these members would never have returned to work.
Whatever the outcome of our deliberations on the question of an appeal, we want CWU Branches to know that the union will continue to look at every conceivable way of supporting these members.
We will update you on any future developments.
