Gross Misconduct for using facebook?

Here's one for everyone...
I am currently suspended for walking out with stress on Tues, I have a sicknote from my doctor stating im suffering from stress.
I had a meeting with my line manager this morning and apprentley Im up for two counts of gross misconduct, one for walking out after breaking down with stress (and also bullying and name calling from another member of staff)
and the second for posting my thoughts on facebook, At no point do i mention Royal mail, my friends on there know im a postie and its them who have mentioned Royal mail,
so if i do get sacked i will be fighting this using every source, the union, law courts and the press..

Good luck m8.. And i'd go back to the Docs ASAP tell them how you're being treated since walking out, basically everything in your Post and tell them you're feeling twice as worse! as long as your Doc has up to date notes its only going to go in your favour..

If what you say is true(no offence) then your manager is digging a hole for himself.
Neither charge of gross misconduct will hold up.
How exactly did he find out about the FB posting? :whistle

One of my colleagues told them about the comments i had put onto facebook, so at the moment exact source unknown, im gonna ring a union rep in the morning, my office doesnt have a rep due to our last rep being promoted to trainee manager.
I gave my manager the sick note during my meeting this morning, but if he accepted it or not is unknown, he's gonna write to me to when he's decided on how he's gonna proceed with the charges.

I would wait until you have the letter stating his intentions and more importantly until you've spoken to your rep.
Your rep will tell you how to proceed with an individual grievance if it's necessary.

It depends on what comments that where made, anyway, those people under stress can make comments (both on and off line) that they would never make when they are feel better.

If the original comments did not explicitly mention Royal Mail it would be better to keep them up.
Deleting them would just make him look guilty anyway.

A fireman from Greater Manchester won £80,000 in a case similar, the verdict was: you can't stop someone from having their right to freedom of speech, so i'd expect this matter to be brushed under the carpet quite swiftly.

What have you done about the bullying you mentioned.
What steps has RM took about that, pretty strong mitagating circumstance if bullying is proved to have contributed to you walking out with stress.
Were was RM and Doms duty of care towards you before and after your breakdown with stress.
This ain't no baseball game, you get only one chance and you blew it.
