I think he is right this is where TUPE comes into play - although the POs that transferred to WHSmiths had problems.kitkatchunky wrote:they will not drop our wages i asked my local repwiganpostie wrote:Can't do any worse than it is now? Of course that only means that on transfer/takeover our T&Cs remain the same, it does not mean they won't be attacked or eroded in the following years.TUPE protection
To be protected under TUPE, the business transfer or service provision change, must take place from a UK-based company. It is possible that some transfers will be a service provision change and business transfer. For example, your employer outsourcing a service. This will not make a difference to your job.
You are protected under TUPE, regardless of the size of business you work for. It doesn't matter if it is a large business with thousands of employees or a very small one, like a shop, pub or garage.
If you are involved in a transfer that qualifies for TUPE protection you should be guaranteed that your:
* job transfers over to the new company
* employment terms and conditions transfer
* continuity of employment is maintained
If you are unsure if you are protected by TUPE you should seek further advice. Acas (the Advsory, Conciliation and Arbitration Services) have a helpline offering free, impartial and confidential advice on all employment areas. Alternatively, you could contact the Citizens Advice Buerau or, if you are member of a trade union, your trade union representative.

Re: Don't back the union on this one.
Looking back to the last strike – there was a meeting with the CWU and Mandleson with regard a tie up with TNT – this was knocked back due to the leverage of the unions and the upcoming election. I think people were kidding themselves if they thought privatisation was going to come off the agenda. We are now in a situation where we have government whom we have very little leverage. However, before we all start slashing our wrists should we not ask a few questions first.
Who would take over the business in the current climate? Most of companies who are potential purchasers of the company use the service and make a good profit from downstream access. Which of them are going to take on the pension deficit or pump in the investment funds required for the business and risk their own companies viability? They’re many examples of mergers not working out for either party. This government may have an intention to sell but it still has to find a buyer who will deliver a universal service, which I think it will very difficult to achieve. (But not impossible) Personally, I am not in favour of a strike just on the issue of privatisation, as I don’t know which company will take over, what changes to our terms and conditions will be. (I am sure they will be changes!) But until we know, how do make a decision on whether to strike. And all of this is IF they can find a buyer!

Re: Don't back the union on this one.
That's exactly what would happen TBT.
The first thing that would be attacked would be MTSF.
Then all your allowances and pay protection would go.
Then finally you simply freeze the basic pay until it reaches a level(around the minimum) that the business feels is sustainable.
Still it would do away with all of this pro-rata nonsense.
I don't want anyone getting the idea that i am pro-privatisation...nothing could be further from the truth but you have to know what you are doing in these circumstances, why you are doing it and most importantly...do the members support your actions?
I don't think the union knows the answers to any of these questions.
Billy's antics on the BBC seem to underline this.

You have to see the pension pot and pension deficit in real terms.
It's like borrowing 20k from the bank over 10years.
In the long term you know you'll be paying back 30k so you technically have a deficit of 10k.
But in the short term you have 20k to play with.
A Goverment that may or may not be in power for 5 years is not really focused on the long term...and we're talking about £20billion not £20k.
