All correct , however the Royal Mail IB can only interview at a police station witht he authority of the senior officer at that said police staion under thie guidance under PACE
Any interview outside a police station can only be taken as a staement by an employee as the IB are only employees of the Royal Mail.
I had this confirmd by the home office and legally withdrew a statement i made to them under thier question as it was inadmissable in a court of law (section 9 and 10 criminal justices act) as thier was no legal authority present at the police station whilst being questioned by these goons i ad the right therefore to withdrw my statement and legally the interview with them was no accepted in court as the staement was seen as two employyes trying to obtain confession and was drove ota court faster than lewis hamilton.Trust me i am right i went through all of this and more

Apologies for the bad typing ,rushing at my work.

The RM will stoop very low also to get you convicted.
My line manager a witness in court told a court of law that the PHG was at the DO i worked at until SEVEN O CLOCK at night and he starts at FOUR in the morning.
My line manager told a court of law that i was expected by the RM to work time over my contacted hours FOR NOTHING AS IT WAS PART OF THE CONTRACT!!
The Royal Mail IB told a court of law they informed me that it was CITEZENS ARREST when they stopped me ,this was not true i was called to my managers officeon the said day where three men introduced themselves as IB and my manager LOCKED ME IN THE OFFICE WITH THEM .IB then told me i was under arrest and was being detained despite the fact that i was legally entitled to walk away.They took notes of wht i said and used these notes in court at no point at all wuntil five hours later was i arrested by the police and i was NEVER intrviewed by them AT ALL.I was locked up for nine hours in a police cell.
The IB confiscated my car keys (again this is not in thier power i did not know this at the time) they denied this in court as well.
My line manager told a district judge that D2D in 2006 was part of my four hour a day contract and was up to me to finish /prep them and complete them within the 4 hours a day i was contracted to deliver mail only.(bag carrier)
My line manager and IB staff denied he had heard the term p739...(true) and i was convicted of mail delay even though the mail i had was that of undeliverd parcels and letters that required a signature with 739 written on the outside of them..
My line manager said he did not know what i said i meant when i told him letters i had picked up from a sorting frame where in fact letters that needed "killing off" by the person employed to sort my walk that day i had a bundle of them in my red bags BEFORE DELIVERY as i was detained before going out on my walk that day i was convicted of mail delay on these items also .
The previous day i was on overtime(before my "arrest")and i undertook two full deliveries that day ,it was the only way i ccould make money rom the 21 hour a week contract i was on.I worked that previous day till six at night delivering mail as a favor to my dom,naturally there was parcels that could not be delivered and letters to (recordeds etc oh and specials)therefore with no open DO OR POST OFFICE OPEN THAT TIME OF NIGHT I LOCKED THEM IN MY CAR IN MY GARAGE OVERNIGHT ,(A PRACTICE MY DOM KNEW ALL ABOUT) and something i knew was not right but what else could i do but safeguard the mail?.
Wrong when the IB and police opened my car bingo they found the items ,i was convicted of delaying these items as well of cours my DOM said?....he never was told..watch your back i could go on easily

Ps at no point did i EVER ADMIT TO DELAYING MAIL WILFULLY i said mail had beend delayed because of circumstances and work prcatices and was fully unintentional.
If you read the postal services act there has to be a reasonable excuse for the mail to be delayed and the Royal Mail within thier own disciplin proceedures accept that at times it cannot be avoided .

However they were after my blood big time as i never pleaded guilty .
I also won my tribunal as i wa given judgement in default as my ex dom never ackknowledged my claim,ignored acas and did not tell his superiors of my claim of constructive dimissal (as i resigned) he failed to show up at the judgement meeting .i was awarded a lot of compensation.
However this ran paralell with the criminal investigation and the Royal Mail stopped me from using this in court as part of my defence ,but it was fukin hilarious when they found out in a court of law i had won my tribunal cos nobody knew nothing about it lol cue the quickest adjournment in history i fell off my chair laughing i tell you.

Long story short(promise)they blocked using the tribunal as evidence for the defence (mmmmm what do you think?) the Rm also told me i had to hand any evidence of thier work practices over to them during the trial..i told them to f**k off
Adfter they secured concivtion of wilful delay they then revoked the tribunal judgement based on the fact i now had a criminal record under thier employment .Not that it mattered to me i had a uge moral victory and it cost in total for the RM to take me to court and tribnaL £26.000 , I laughed out loud on the day of my sentancing when it was announced the costs of the investigation .Yep i got a criminal record here is what i was sentanced 120 hours community service 120 hours suspended prison sentance for each charge of wilful delay and £2000 fine (later reduced) to £340 by a kind magistrate (they dont know that ) watch yer back people ..i have a very funny story about my dom as well after my court date which i may post or may not lol lol

Please dont get me wrong or be quick to judge me i dont hate the royal mail in fact i loved the job once ,however thier own proceedures and stupid work practices and a little bit of my own naive self confidence ?..became my downfall, i aint no criminal ,never have been and never was(in the eyes of the law i am now)i just want this guy and others to cover yourself and be aware of the level a large corperate company will go to when things dont suit them even when they make the rules.

Any ways is my favorite extract from the trial (slightly changed )

judge in a loud voice annoyed and upset " Mr X (Me)do not tell me how the postal services operates ,i know how the postal sevices operates ,do not tel me lies!,what i want to know is why you did not take those parcels back that very night and not the next day?..you have the keys to the post office and all post boxes do not tell me that as a postman you dont ,everybody in this room connected to this company knows this and so do i do not insult my knowledge of the postal system im better infomed than you think".............losing battle really wasnt it?

I feel that I need to clarify my thoughts on this post, indulge me for a minute cat haters! No, I'm not a manager I'm a 32 hour OPG in a town office in the South East. I wouldn't spend half my time on this forum slagging off linos and management in general if that was the case would I?? Unless its some very very very elaborate ruse on my behalf which I could not be bothered to do in the first place............ Now we've got that out of the way, lets go back to the start of this thread............and I quote:

I have a real problem with this statement because this is where this individual's problems started. I can't understand why he didn't just ask someone? Even if there was no one in the office coming back from delivery, then surely you would just put your bag on your frame with a note explaining what you have done and go home? Next day, ask question when the office is full of postmen? Are you seriously telling me that this person is so 'upset and scared' that he couldn't even ask a question??! Every day he came into work and said nothing??? Come on! Even the most timid person in the office peeps up from time to time?? And even if this were true (and its a big IF) I would ask myself what is this person doing in a responsible role handling important items when they can't even conduct themselves in an adult responsible manner?

And therein lies the rub..........all too often with people and society in general, it is always someone else's fault. Lack of responsibility extends from having children to looking after a dog and beyond. When something goes wrong, well it was so so so said so or there wasn't a sign up saying I couldn't.......the list is endless. When are people going to be honest enough to put their hand up and say 'I'm sorry, I made a mistake, how can I put things right?' No, I'm not perfect and yes, I have dropped clangers left right and centre and boy! have I learned from them - by being honest about them in the first place.

My second problem is the universal belief on this forum that it is always Royal Mail's fault Yes, he probably didn't have adequate training and yes, things could have been handled better by his line manager and DOM but they have their responsibilities and clearly they failed theirs too. Get my drift? It's a vicious circle.

In conclusion, please stop blaming everyone else for your own foolish actions, take responsibility for your mistake and take your punishment like a man. And for all the tree huggers and do gooders out there I genuinely believe that this person should get some therapy before he even thinks about taking up another job.

That's a much better way to get your feelings across rather than a few generalisations and acerbic comments.
I still don't entirely agree with what appears to be a very negative opinion of anyone who doesn't achieve your very high standards.
....but at least i can understand your position. :wave

:crazy: Maybe I'm a wee bit biased smelly, although I set high standards for myself, I have seen many new starts come and go over the years, who, through lack of adequate training, and support from Management, (and quite often being given the wrong advice in the first place--) making mistakes, then being booted out the door. some of these chaps, were so keen on the job, and with proper back up would, in my opinion went on to be first rate posties----whilst never condoning the delibertate actions of some who deserve what they get, make room in your heart for the genuine 'inadvertant 'mistakes that some people make!

I'm not a cat hater...

But one has to remember (how posh am I?! hehe) that what is typed on a message board can come across a lot differently than intended, as body language makes up a major percentage of how we communicate.

Please just think/re read your post before you click submit. I'm not saying everything should be nicey nicey and no one can have an opinion, just think about what effect you want your words to have before you post.

One thing I haven’t seen directly mentioned here, is peer group pressure.

ashy has alluded to it here though with his comments about no one delivering after 3:00pm.

Not surprisingly, as a new starter it takes you longer to do job than someone who is an old hand. Yet the newbie will hear comments around them in the morning about how light the previous day was or how early people got finished and will be comparing that to the time it took them to complete the duty. This may be exacerbated if they find themselves working alongside a flyer or two, or worse still in an office of flyers.

They may well get told that someone else completes that duty in 2 hours and they’ll be thinking about the 4 hours it took them, little realising that most of their colleagues will always under-estimate the time it takes to do duties other than their own.

The tendency for the newcomer is to put themselves under time pressure. It is human nature. They don’t want to appear to be slower than the other people that they work with. It makes them worry. It makes them feel a little inadequate.

So, perhaps, there’s a lesson for us to remember back to when we first started and how ‘pressurised’ we felt and to think a little more about how our current comments can be interpreted by a new starter.

Where are the Royal Mail MENTORS?

This chap needed one, not some old time posties who wants to get his delivery done quicker using his car!

We have no mentors in our DO, peeps are shown buy an "experienced" postie, yes using a car, coming in early............. :no no

But I do understand where "smelly" is coming from! We all need to get a grip and fight for your rights (to party) :crazy:
