Re: May 7th Lump sum £400 for part timers? agreement broken
just getting my emails ready - if there read ill be lucky lol, what do people think of this
I am writing in regards to the deployment of the national agreement, there is an issue which I believe needs some serious attention, I am in the understanding that employees will be paid the £400 for ratification of the agreement on a pro rata basis. This is not what the agreement states and as such I believe the national agreement has already been broken. Clearly in black and white the agreement reads " April 5th 2010 – 2% Increase to basic pensionable pay flowing through to all allowances London Pay Range, overtime and SA rates. £400 lump sum (previously final ColleagueShares dividend) paid to all employees upon ratification of agreement. "
Their is no Pro rata in this statement and as such ALL EMPLOYEES SHOULD RECEIVE THE £400 FOR RATIFICATION OF THE AGREEMENT.
I also believe that the ballot was invalid if royal mail decide not to pay all employees this £400, employees voted in good faith on what the agreement states, if they knew that they would not receive this £400 and had a pro rata payment instead there would probably of been a higher amount of no voters, if this agreement is incorrect or is missing certain sections or text then surely there should be a possible re-ballot on a reworded or edited agreement.
Their is also the issue of legality in the non payment of the full 400 pounds, in a court of law or tribunal, i would certainly imagine that the claimant (employee) would win the case and receive this entitled money and cost royal mail the court costs.

In the agreement it says 400 for all employees in the table on page 62 ("Year 1" field, 2nd bullet point). As I read it, that's purely a summary of the 2nd indented para under "ColleagueShare/Lump Sums" on page 59:tragictramp wrote:in regards to the £400 pound bribe, what will the part timers like myself get, in the agreement it says 400 for all employees, but surely this is pro rata?, my union rep insists it will be £400. If as i expect it is pro rata, then the agreement would have been invalidated immediately as they have broken a term of it. It says the d2d payment will be pro rata and the additional transformation lump sums as well but not the may 7th!
The final instalment of ColleagueShares will be replaced for employees covered by this agreement, by lump sum payments including additional monies bringing the total to £1000 (pro rata for part time employees). These will be known as Transformation Lump Sums and payment is linked directly to key transformation milestones.
In essence: no chance.

Transformation Lump Sums is nothing to do with the ratification though is it. And as we know agreements need to be water tight. Once again this is not.visigoth wrote:In the agreement it says 400 for all employees in the table on page 62 ("Year 1" field, 2nd bullet point). here is what it says:
o Additional Transformation Lump Sums totalling £1000 for employees
covered by this agreement (pro rata for part time employees).
Annex C gives
the detailed trigger points for implementation of the lump sums in each
function.
Annex C
Transformation Lump Sum Payments and Shorter Working Week
Delivery
Applicable to all Delivery Units including SPDO’s.
Lump Sums
The payment of £1,000 (pro rata for part time employees) consisting of 3 lump sums wil
be paid as follows.
£200 will be paid to everyone in the delivery unit on deployment of their first non
walk sequencing revision.
£600 will be paid to everyone in the delivery unit on deployment of the walk
sequencing revision.
£200 will be paid to everyone in the delivery unit when the Walk Sequencing
revision has been implemented, and objectives achieved in line with the loca
agreement and no later than the end of the 6 week bedding in period.
i do not see a £400 payment here at all can u? the £400 is just for the agreement not a transformation lump.

Re: May 7th Lump sum £400 for part timers? agreement broken
I've no idea what's gone before (how much/many) in terms of CS payments. However, in the bit I put in blue, it's easy to interpret as "The final instalment of ColleagueShares will be replaced ... by lump sum payments ... these will be known as Transformation Lump Sums".
Thus the (presumably) final CS payment of (presumably) £400 is "rebranded" a "Transformation Lump Sum".

The word on the payslip on Friday will not say TSL though, it will say Ratification Bonus, or certainly something similar. I do see your point though, the agreement is open to interpretation (again).visigoth wrote:I've no idea what's gone before (how much/many) in terms of CS payments. Quite right, no £400 listed in the 200/600/200 schedule. This week's £400 (pro rata for P/Ttragictramp wrote:... i do not see a £400 payment here at all can u? the £400 is just for the agreement not a transformation lump.

That said, interesting point arises in respect of what was said in the other thread:
"Well there is soome debate about when the transition is to take place pop. Dingo and his buddies are apparently meeting with RM to receive instructions as to when the agreement becomes active on D2D - RM haven't decided yet."
Except RM don't get to decide, cos p62 clearly states "April 2010. For Delivery employees a £20.60 pw permanent supplement to basic pay (pro rata for part time employees)."

Well here's another bit that can be interpreted:Pat Ostman wrote:The word on the payslip on Friday will not say TSL though, it will say Ratification Bonus, or certainly something similar. I do see your point though, the agreement is open to interpretation (again).
"Additional Transformation Lump Sums totalling £1000", payment timetable as per Annex C. If they (the 200/600/200) are "additional", there must be (at least one) "Transformation Lump Sum" they're additional to.

Why?
Have you any idea, how many London Reps there are?
If he'd said which PART of London he's from, I could understand your reaction.
