A DOM informed me today that D2D must be done in our own time. I disputed this but without a hard copy of the agreement I had to leave the discussion open.

How can D2D be delivered without it being part of the workload? I can argue "must be sorted and delivered along with the other mail during existing duty time" and the DOM can argue "existing duty time with no additional hours".
Which one is the correct interpretation?
P.S. more specifically, I cut off and said if I got back early I would prep D2D's to which I was told I must do that in my own time ... etc etc
You don't need to worry about the "left out of workload " part.
That has no bearing on when it is done and only relates to traffic/duty revision.
If he continues to argue that they must be done in your own time ask him if D2D is therefore voluntary.
This will confuse him and he will probably dissappear into the distance mumbling to himself.

Both I hope this clears it up:
1. D2D is not in measured workload at present and docket cannot be claimed purely on D2Ds.
2. It is part of the normal workload though and should be prepared and delivered within normal working hours but no additional hours are provided.
One good thing about 2010 is that it will clear up such confusion caused by either party reading the above sentence in a certain way.

Yes TBT...this year instead we will have "I had 2 D2D on monday and then another 4 came in on wednesday and a day specific on saturday and my DOM is only giving me enough time to prep 2 and i said i could cut off but he said that now D2D is in workload it means i can't but i said that it's like live mail but he said that i have a performance issue and the agreement is soooo vague and my union rep is useless.....please help!

No argument - they have clarified one part of D2Ds only to raise confusion in another.
However, anyone who is unsure, you are allowed to cut off and they cannot make you work beyond your time without your consent. I would recommend doing as Fishtank undoubtedly does know your rights and stick to them.
