NO STAGE MEETING OR NOTES TAKEN!

Hello Everyone,

Basically I had a stage 1 issued but never had the stage meeting. I also requested the meeting notes (knowing full well they don't exist) and was told that the meeting did not take place. I also know that I haven't signed anything to say that I had the meeting. My acting manager at the time rang me on my round to say that I got away with it although I cannot prove this unless he admits it.

1) Does this stage count? I know that absences are "automatically triggered" BUT..are "automatically triggered" and "Given" two different things?

2) I am now up for the dreaded stage 3 but I am pushing for a procedural error ie. the correct disciplinary procedures were not followed. Do I have a case?

yes being triggered and being issued are different, triggered are automatically and issued is up to your manager, if i were you put in a grievence against it on the grounds you didnt have a meeting and therefore you were unable to put forward any reasons why your line managers might consider letting you off.

I would greatly question the min payout is £66,000

If you win
The Employment Tribunal can order your employer to pay compensation. The compensation is unlimited for discrimination or dismissal on health and safety grounds.
For unfair dismissal claims the award is made up of:
the basic award, worked out based on your age and length of service
a compensatory award, up to a set limit reviewed every year (although the maximum is rarely awarded)
The Employment Tribunal can make an additional award on top of the two awards above. This is awarded if it orders your employer to re-employ you but your employer does not.
Up to £25,000 can be awarded for wrongful dismissal or other breaches of contract.

God i'd love to work in some of the offices mentioned on the site,i would have a field day with management.

The manager managed to convince our rep that I was in the wrong on this one (Our rep is clueless) and thus the rep quoted back to me word for word what he said.

He told the rep that automatically triggered is the same as given so I said why do we bother going into the office for stages then if they are given whether you attend or not... to which he shrugged his shoulders. I even tried to argue the point of the stage 1 in the stage 2 meeting and he said he "wasn't interested in that and I'm only doing the stage 2".

Absolute joke at our place and this goes on a lot!

Demand - yes Demand that the Area DR attend your stage 3 as you feel your own rep does not have the required skills to perform the duty. If possible do it in writing and be up front send a copy to the manager, local rep and of course the Area Rep. If the ADR is any good they will step in for you.

BTW IMHO how can they say triggered is the same as given - even if you pull a trigger on a weapon it does not always fire. Triggered means the processes has started not the process is complete.

Hi all,

An interesting update.

I received all of my stage notes and Absence Report today, and it made for some extremely rewarding reading.

First off and you'll never believe this. The last dates that were on my absence report and the ones that triggered this stage were.... My rotation week!! YES, they have me down as sick on my rest week!! Unbelievable! I was sick a few days before this and they added a whole week which triggered the stage. I even made it known to them that I was available for work and I have two witnesses to prove this. Unfortunately I am now off ill from a stomach bug which really couldn't have come at a worse time, this means that I will definately get the stage as this is now 3 absences.

Secondly, enclosed in my notes was an interesting letter from my DOM requesting my stage notes from my 1st Stage (The interview that never ever took place) and it said this:

"Can you obtain Mr *******'s personnel file so that I can confront him with the evidence, if not I do not see how I can issue stage 2."

SOooo, even doubting himself that I cannot be given a stage 2 without the notes he STILL issued my stage!!

So to summarise:

1) A stage 1 that I never attended but was given anyway
2) Down as absent on my week off
3) No return to work interview after any of the aforementioned absences
4) A signed letter from a DOM stating that he cannot give the stage 2

I feel pretty confident that a stage 1 or 2 will be re-issued but you never know with Royal Mail. Any suggestions or comments about this?

Put in a stage 2 grievance to your line manager's line manager:

" My line manager failed to follow the correct attendance procedure and this has caused me a great deal of distress. Please provide someone competent to sort out this mess. I do not feel I have been treated with dignity and respect."
