Internal Job Application

Hi all,
I dont work for Royal Mail however really respect what you guys have been doing.

I have a question for a CWU rep, if this isnt ok please let me know and i'll withdraw.

I currently work for a well known credit card provider as an advisor, after 2 years excelling above and beyond my role but with no career progression due to staffing levels i started looking elsewhere. I was recently offered a job for a management position for another company.

As a good employee i made my operations manager aware of this and advised that it was more than likely that i'd be handing my notice in shortly, she then advised that she'd find out if anything was coming up internally and would let me know by the end of the week.

Come the end of the week the director of operations, knowing that i was looking to leave, asked me if i'd be interested in a training role and that one was currently advertised externally but they may be able to make an exception. Training being an interest of mine i proceeded to follow his instructions and send an application to the head of hr, I had 4 weeks to accept the job from the new company so figured what did i have to lose. The head of HR called me and said that he would be able to make an exception and allow me to go for the position but would need to offer the job internally so to be able to interview me.

The next day the job is advertised internally.

2 weeks pass and i have now told the other company that i wont be accepting their job (not just because of this internal job, lot of travel involved etc cost more than worth) all the while being fobbed off with excuses as to why no interview etc has been arranged (in fairness both the head of hr and head of training had been hospitalised within the last fortnight) .

I then find out yesterday that the training position was filled before me and the director of operations had even spoke and it would appear that the position being suggested to me and offered internally was a ploy to prevent me accepting the other job.

Where do i stand in terms of the legality of what they have done?

Where do you stand legally?
Nowhere unless you have documented proof that the job offer was a lie and even then you would have to prove motivation.
I'm sure your manager would simply call it an oversight.
What you really have here is a "life lesson".
Move on,keep looking for another job and when you do find one,keep your own counsel.Sorry.

I would concur with this i'm afraid. This practice goes on a lot more than one thinks.

You could approach ACAS or CAB and see what they say. The only avenues that would be open to pursue a case would be a "Breach of promise" and or "Constructive Dismissal" as I understand it you don't even need to be dismissed or leave for a "Constructive Dismissal" case.

TBH ACAS or CAB are the best as they will have a lot more up to date knowledge than a CWU rep.
