Beverley Jones, from Stockton, was so concerned about the Royal mail worker's head injury that she dialled 999 and carried out first aid while they waited for an ambulance to arrive.

Miss Jones, 47, then contacted the Post Office to let them know about their employee's fall and later rang the University Hospital of North Tees to check on his condition.

The postman was so grateful for her help that, she says, he called at her home in Rothbury Avenue, Roseworth, three days later with a bunch of flowers.

But two months later, Miss Jones was shocked to receive a letter informing her that he was taking legal action against her for failing to clear the ice and snow from her path.

Miss Jones, who is unable to work due to sickness, insists she always keeps her path clear in bad weather, but hadn't yet got out of bed as it was only 8am on a Saturday.

She said: "I could understand it if he'd been bitten by my dog or if he'd tripped on an uneven paving slab.

"But this was an act of God. When he dropped the flowers off for me, he even said that he wasn't holding it against me.

"It seems like made a complaint to his work, not got anywhere with them, so he's just passing the blame on to me."

The postman is being represented by Simpson Millar solicitors in Leeds.

The firm sent a letter to Miss Jones, explaining: "The reason why we are alleging fault is because you failed to ensure that the pathway was clear, so as not to pose a foreseeable risk of injury to the claimant in accordance with the Occupiers' Liability's Act.

"Pursuant to the Occupiers Liability Act you have a duty of care as occupier to provide a reasonably safe passage to lawful visitors of your property."

According to the company, he suffered a "severe laceration" to the head, as well as neck and jaw pain.

It is understood that the postman, on learning that Beverley would be directly involved in any legal action and the issue would not be handled through insurers, has since decided to drop the claim.

A Royal Mail spokesman said: "Royal Mail has no knowledge of any legal action concerning this incident."

Im inclined to agree, i was under the impression that if householder did clear path and postie slipped then he could claim, not if it wasnt cleared, whatever i would need to be thick skinned to claim against any of my customers, unless of course i had to take time off work or was so badly injured, im glad to see though that the postie has dropped the claim after he found out she was directly involved

I decided to claim because its been over a year since my AOD and my leg has'nt got much better even though I've had ongoing treatment physio/injections. I have to take painkillers/anti inflam just to get through my duty. As far as I know Simpson Millar decided RM were to blame as no risk assessment/severe weather policy in the office last year. I don't know if the footwear is part of the case as I was wearing RM issue Magnum Ice Skates.

lets be honest 8am or 8 pm. she wasnt going to bother anyway.
out of just under 500 houses only one drive was cleared for me all winter.
i even had some bloke say"wouldnt like your job today with all this ice"as i stood outside his door after going up his very steep ice covered steps on all fours.steps go up at least 6 ft,i told him ,"dont worry if i fall your paying".did he clear them for next day...of coarse not.

How do you know she wouldn't have cleared her path? What is the timescale from when the snow fell to her having to clear the path? Then again someone would probably try to sue her if she cleared the pavement outside her house as well.

I think the world has gone a bit mad;I don't need a severe weather warning,I can see that it's snowing. Accidents happen and it doesn't have to be anyone's fault.

So its ok for me to incur the costs for my treatment etc because RM fail to recognise the dangers involved in doing my job??
