Royal Mail has also accepted that the national ballot and all local ballots remain enacted.

Does this still apply?

Well if there is a 3 month deadline and the 6th is the enactment date then we should have a week left shouldn't we? So lets just see if they can spin it out for another week.

Unfortunately dvb it's 3 months since the last day of industrial action that counts and since the IA scheduled for the 6th/9th of november was called off at the 11th hour that ship has already sailed.

I must be just as naive for in all of the truth's and dingo's fun and fact filled posts i cannot for the life of me remember a mention of the impending expiry of the local and national ballots.
I just cannot understand how such an important and pertinent fact could have been ommited.
Maybe i should go back and re-read them.

Dvbuk the Industrial action ballot is dead , its been 3 months since the last action. So to call further national strike action we would have to launch another campaign to achieve a yes vote.

Somebody is a cheating lying bastard then, because the membership were given the clear impression that part of the terms for entering into talks and suspending industrial action was the clear undertaking given by RM that the ballot would remain live for the duration of the talks . No! Don't tell me you didn't know either B - but according to the truth/dingo everybody knew Well apparently we didn't know and what's more to the point it has never once been mentioned until now. If the negotiators were aware of this why wouldn't they have made sure that failure to reach agreement meant we still had the ballot in place?

Any take on this the truth/dingo - it would appear there ARE more people who didn't know than did.

And we misguided fools thinking that if the deal is crap we would restart the strikes immediately.

I also thought / NEW because thats what we were told that the ballot would remain live by HQ! If there was an issue about the ballot remaining live alls they had to do was call a 15 minute strike on any Tuesday and inform RM that this should be done instead of WTLL so as not to impact deliveries so that the ballot could remain live, how hard would that have been! If the ballot is dead then that speaks volumes to me.

Yes it does it tells you just how little intention HQ had in calling any more strikes at any point.
It is time for all this bluster,bullshit and spin to end.
Put the deal before the membership and if it is good deal it will surely stand on it's own two feet.
If not we will move on and take whatever executive action is coming.
At least we will know our enemy then.

Anyone else feeling duped by the "trust us , the strike ballot remains live" LIE

I will wait for the agreement to be published, then I think I will hand in my union card. Being lied to by RM is expected, but paying £3 a week for the privaledge of being LIED to by the very people who are supposed to be looking after our interests sticks in my throat

We know that the question on everybody’s lips will be: “Can we trust Royal Mail?”. The truth is trust is not
going to be built overnight and it is evident that there are still some managers at all levels who are trying

Once the initial action has taken place within the four-week timescale, further discontinuous action can occur outside the timescale as long as:

Further action is a continuation of the same trade dispute.
A further seven days' notice is provided.
The notice will cover discontinuous action provided it occurs on a day that has already been specified in a notice. Failure to take action on any of the specified days will not render previous or future action unlawful.

If continuous action is called off or suspended other than by reason of a court order or undertaking, a fresh seven days' notice must be given before action is resumed.

Where the union suspends industrial action for the purposes of negotiation with the employer, but then seeks to revive the action when negotiations break down, it is unclear under current legislation whether a fresh ballot would be required. However, in Monsanto plc v TGWU [1987] ICR 269, following a ballot, industrial action took place, but was postponed for ten days to allow negotiations to take place with a view to resolving the dispute. The negotiations were unsuccessful and the industrial action was revived. The employer successfully applied for an interlocutory injunction at the High Court, but this was lifted on appeal. There is no info on the ballot timetable in the interim agreement daz and thats where it should be if there was an agreement to leave the ballot live whilst talks continued.
