So what your DIM has done is co-hearsed the response he wants out of the complainant as the first complaint doesnt hold up What a big fkin joke.

I take it you have copies of the original complaint and have informed your div rep of this second statement.

This stinks no way in a million years can this now hold up .

I think you should be thanking your DIM for his actions on seeking a second statement ,but you never know in the R/M world.

Make it clear that you now want an outside source dealing with your case due to your DIM influencing the complaintant and him having other motives regarding your case.

Well all finally resolved it appears someone high up in the RM food chain didn`t like what was going on so i got an apology
see miracles do happen
still very wary because my DIM wont like being told off, think i will need eyes in my arse from now on!

From what I know appendix 4 is only applied to accredited reps. The list of accredited reps can be got from your branch. Most floor reps are just union dogs bodies and are not accredited, when the sh1t hits the fan you will not be able to use appendix 4.
You are an accredited rep if the vacancy of rep was advertised and the nominees were voted on in a proper election.
If you are a shop floor rep, you know someone nominated and seconded you then you will not be accredited and appendix 4 will not help you.
Someone with more knowledge please comment on this.

similar thing happened to me. suspended for 2 weeks on a trumped up charge , i returned and began taking statements from my colleaugues (ended up with loads!) the case got passed on to different managers FIVE times until 6 months later someone high up came down read the file and told me he was prepared to drop it , draw a line in the sand and move on! i told him no thanks i've had 6 months of stress with this hanging over me and i'd appreciate it if we could see it out in an official manner because i knew i was in the right. to cut a long story short , he knew it was a complete f*ck up and eventually got the dom to apologise to me in the next mornings huddle!!! you're right though , you need eyes in your arse after something like this.
