well im told by union that i have a very good chance of winning due to management not following rm procedures and a certain DOM over-reacting .dont wanna say too much coz rm have eyes lol

well im going into my fouth week now waiting on an appeal 4 reinstatement if sucsessfull am i entitled to back pay and wot would be a reasonable relocation as im pretty sure im not gonna be going back to my old office

You will be paid as if you had never left. Im not sure re the door 2 doors. You should however get the £100 bonus.

how long do you have to wait for an answer after the appeal an if you win the appeal does it mean you go back to your old job again an do you get all your wages back dated from the day your dismissed

Sharon there is no set time for turning around an appeal. It really does depend on what you and your reps prensented as reasons why you should not have been dismissed.

The appeals managers has to make a fair and reasonable investigation including putting your arguements to the dismissing manager. In additon the appeals manager may send you further info following his investigation to allow you a further opportunity to make reprsentaton before he makes his decison.

All Appeals managers normally start from the point that a case may be going to an industrial tribunal and therefore know they have to attempt to convince the tribunal that even if there was flaws in the dismissing intrerview that the appeal is a complete rehearing and therefore the appeal can be considered by the tribunal as correcting any flaws in the orginal dimissing interview providing therie a full , fair and reasonable investgation.

If you win your appeal then you will get you job back and all your wages back and that no break in service will have applied so you will retain your seniority and all your leave etc.

Sharon, a couple of questions:

1. You say the appeals manager commented that your DOM made a complete balls up and didnt follow procedure?, did he say this on record?

2. In my experience CSA Appeals never overturn decisions!

what do you mean fmr postie that csa appeals never overturn decisions are you saying thats it i havent a chance im a bit confussed by that an yes i did work the ot i went in early thats why i was home before my accual finish time thats where the hour was going in early

Have never known an Appeals manager to oveturn a decision. But if the DOM has made a balls up with your case then who knows. Like everyone else has said, keep fighting sharon and get your IT/ET in if the decision is upheld. Decisions will take however long it takes, 1 month, 2months you just dont know.

The Appeals manager will probably write to you with details of how the investigation has gone, he will interview your DOM and you should be provided with a copy of these minutes. You can also send a written reply to this.

Cant remember exactly, but that is the unit within P&ODS (is it still called that?) that deal with appeals to my knowledge.

Didnt mean it like that sharon, but RM managers just close ranks. Regardless of whether they are wrong. The important thing is keep positive! Keep us updated.
