i have my interveiw today for gross misconduct an false claim of 1 an a half hours overtime they know what time i finished but they dont know what time i started an some days when id finished i just came home early what am i suposse to do can i say to them i can take them to a tribunal for harrasment an also mention the convention act article 8 for invading my private life am suspended but thre is another lad up with the same charges an hes still at work his interveiw is before mine so could i also mention justified discrimanation to them i know its my own fault i never took my meal breaks as im only there 4 hrs an help please my union man is going to be there

Had to pull the above from another thread,as i couldn't understand whats happened,but maybe that's just me??
Sharon,i'm still somewhat confused,but if i read between the lines,it sounds to me as though,
your on a 5 hour contract? 9am-2pm
when you walk in the office your entire walk should be ready,you still get 30 mins break,and the outdoor element should
allow for 4 hours.
But Royal mail know you cannot do the job in 5 hours,this includes prepping households,redirections,etc..
so rely on people protracting(booking overtime)they even say "i know you start at 9am but you can come in early if you
want"
So did you start at 7.30am(before your time)finish at 2pm and try and claim this time back?
essentially if that's the case,i think that's why the union are reluctant to get involved,they won't support you coming in
early.
This could be very interesting and please let us know how you get on,because Royal mail are saying we will only pay
you for your contracted hours,but you are requesting to be paid for all the hours you have worked.
if you signed in at 7.30,then that cannot be construed as fraud.

think the problem is that instead of putting 0730-0900hrs down as her correct overtime, she added it on at the end on her docket, ie 1400-1530hrs when she clearly wasnt working

Yes,we need the original poster to tell us exactly whats happened,if she's saying i signed in at 9.am but actually came
in at 7.30am so i'm going to try and claim the time back,then that's another issue and they'll simply say we never
authorised it.
If she came in at 9.am and the walk wasn't prepped,essentially she would propably finish at 3.30 anyway and that should be
her argument,they'll try and say if she had of come in on time,the walk would of been ready :hmmmm
But yet again,the lesson is do not come in early!
i cant' remember who it was that said it on this forum,but they summed it up beautifully...

get a tribunal form IT - 1 from the Social now and put a application in now - doesn't matter if you are appealing . RM try and grind people down in the hope that they don't cause them any trouble for them outside the PO . Do what RM don't want you to do - call their bluff .

What happened to that other fella ? they'd up on a similar charge ?

you have to hand in a letter stating you wish to appeal against your dismissal within 3 days of getting your dismissal letter, an appeal can take anytime from a couple of weeks to a few months, if you win you will get full back pay, if you lose you can take them to a tribunal.
