ive had letter forprimarly suspension this morning it says its for alleged gross misconduct ive spoke to citerzen advice an they said ive to mention aricle 8 human rights convention an look at covert monitering only on criminal acctivity surely coming home early an only ever once claimed 1 hr ot is a criminal offence any help on that please

From a Managers perspective, this is bad on everyone. Claiming overtime you have not worked is fraud. I am not talikng about being given the time for an extra half duty and getting done a bit early, that happens. However claiming you have protracted over your scheduled finish when yoy haven't is just dishonesty and IMO anyone doing this should be sacked. I have no objection to staff getting a flyer on light days but I would be annoyed if anyone had the cheek to sit at home an hour early and the have the cheek to submit an overtime claim, this is clearly theft.

Agree with redman's post, but still a little confused re the OP. If everyone else in the office does it how can they just suspend you?

I am confused. You are saying if a manager gives you 2hr OT for some cut-offs and you take 1Hr to do that's is OK. But if you take 4 hrs payment to do a 4hr job and get it done in 3hrs that's not OK? I can't see the difference. I'd reiterate, if job and finish isn't abused it saves on the OT bill as people go straight home.
Dunno enough details in this case but 1hr OT claim the next day you have to say looks excessive. It doesn't warrent a sacking though but a warning. God knows how many managers bunk off early each day up and down the land, do they ever get sacked for that? One rule for them and one rule for us.

Yep please post proper english and like I say if you can give more details in a concise manner then there are alot of people on here that can give you advice. If everyone else does claim ghost o/t then this should be highlighted at the next hearing sharonbar. Has your rep got back to you about how to proceed?

For a first offence and from what SharonBar said she's guilty, I would still think a two year serious would be enough.
However we are now in a culture of sacking people to reduce office hours, rather than the actual serious nature of the offence. The conduct code is being totally rewritten imho.

Jesus this girl has claimed ONE hour OT in a week and she is getting sacked for it. A 20 Hr contract FFS that's not right.
Sharon did you ever work past your finish time or come in early in the week we are talking about? If so this 1hr claim can be put towards that.

And did she take her meal relief? Also Royal Mail have to be very careful that this was not just a mistake, they have to PROVE that you were trying to defraud the company. Not easy to do.
Did you even get the extra payment or were you suspended before you were paid?
From what I know they need to prove a pattern of defrauding, unless you are not telling us the full story the outcome seems harsh.

Postie A - Preps or bags up his delivery but thinks it will take them 1 hour over their contracted time so claims before leaving. (A big No No in my office). The delivery on that day though runs smoothly - no F/L bags all there on time and no Missorts so they don't go over. This on first look would be fraud as they have claim overtime not actually worked - hopefully they would cross the claim off the next morning or inform the DOM to cancel it. Or it may be "Custom and Practice" but this would be a grey area.
Postie B - Your Manager comes to you and ask you to do some docket - you say yes and then you and the manager decide on how much docket you would do it for. He agrees 2 hours docket but it takes you 1 hour. You could tell him the next day but as he had already agreed an amount of docket I don't think he will be too concerned. The difference is that he was aware and although you have ghosted 1 hour there can be no question of Fraud as by definition fraud is dishonest and deceitful and if you keep the manager informed you cannot be accused of either.
I am hoping that the OP has not been dishonest as if so then dismissal is a high probability, if however there was no ill-intent and it was a genuine mistake, then following union guidance and being truthful and honest may result in a "2 year serious warning". It all depends on the ins and outs of the case and how good the rep is, and how strong the evidence the managers have.
The salutatory lesson in the end is as it has always been - Be as honest and upfront as possible and don't claim anything your not entitled to, or that has not been agreed with, preferably in writing.

thanks for your support ips yes i would like to award a serious warning an told if i breech with in a year they can sack me i dont understand some comments people are saying i havent been the first or last for ghost overtime an it was only one hour whats that around 5.50 an im gonna lose my job for that i deliver all mail each day

Part-time Postie B paid till 13:30, gets out at 10 and is finised by 13:30 - on time
This is the problem with 20hr and 40hr contracts with different finish times. Full timers get the benifits of early finishes on a light day but part timers work till their shift end. That is simply not fair but it is a common situation for some. So should these part-timers book 30mins OT or should the full timer come in the next day and say to their manager 'I owe you half an hour'????
What is the worst sin? The part-timer booking OT to get the same benifits as most of their other collegues around them or the full-timer not telling their manager they were sat at home for half an hour being paid?
