Hello troops,
hope you are well?
Short and simple question.
I have been off work for about 3 weeks now with 100% work related stress. Before I went off on the sick my bullying, deceitful, lying Assistant DOM was building a conduct against me. This conduct case has now been sent to a senior manager.
Can I be called to attend a conduct interview whilst being off work with 100% work related stress?
Can I be dismissed whilst being off with 100% work related stress?
ATOS have told the managers that I can not be called for a conduct interview until I have had a chance to put all my points forward on why I am off in the first place. As the conduct case and the reason I am off all intertwine one way or another.
I am already have a '2 year serious warning' on my file from a previous case my Assistant DOM stitched me up for.
As usual any help, advice or comments are much appreciated.

Get your reps involved if you can or if you can`t get hold of them then ACAS are very good at telling you what to do.

I think there was a case when somebody's GP categorically stated that any disciplinary / conduct interviews etc would make a condition worse . I think they were trying to get him to have the CofC done by post and the union told him not to cooperate in any way .flaminmoses wrote:phone acas up imo
ATOS's stance is " interesting " - RM politics / pressure or no pressure .

VICTIMISATION springs to mind, you need to speak to a good employment solicitor, Simpson miller are very good they are used by the CWU, ask your rep not your office rep, go straight to your branch sectretary, they know alot more about this sort of thing.Good luck.

Hi Sci-Dog, For any conduct matter, there should first be a fact finding interview where you and your union rep put forward your side of the argument as well as your dims, then to determine if you have a case to answer. If no case then the process stops there and no further action should be taken, with nothing added to your record. Also as I'm not sure if this is solely an attendance matter, if that is the case your line manager should invite you and your rep for an interview prior to any stage decision.
Should you have a case to answer then your dom has to decide if he can deal with it himself (he cannot dismiss or serious you) or if not he passes it up to his superior manager.
From what you say in your post your manager is not sticking to the agreed procedures and therefore the union should shoot him out of the water. I agree that you should get as high up union representation as you can, eg branch chair.
In the past I have gone through the same situations, both conduct (stitched up by a customer) and stage 1 2 and 3 interviews.

Hi sci dog stress is a very serious illness it can lead amongst other things to depression and have all sorts of effects on your body and your life, i have suffered from both, i became a stress management counsellor with a diploma, if you need any advice send me a message via the private messaging service on this site. in the meantime contact your area rep and ask him to inform your dom that you are suffering from work related stress and that any contact should be made through your cwu rep
