Restriction on providing work-seekers in industrial disputes
7. (1) Subject to paragraph (2) an employment business shall not introduce or supply a work-seeker to a hirer to perform -
(a) the duties normally performed by a worker who is taking part in a strike or other industrial action ("the first worker"), or
(b) the duties normally performed by any other worker employed by the hirer and who is assigned by the hirer to perform the duties normally performed by the first worker,
unless in either case the employment business does not know, and has no reasonable grounds for knowing, that the first worker is taking part in a strike or other industrial action.
A lot depends on how a court of law might define 'other industrial action'. Would the mere fact that the CWU is in a legal dispute with RM constitute being 'industrial action'?
There is much that can be done within offices to stretch its resources without resorting to illegal practice or practice that leaves you open to a conduct code.
There is not an office in the country that does not run on the goodwill of CWU members, so withdrawing that goodwill is a perfectly legitimate practice which would strain RM resources considerably.
Ask your Rep to question the DIM DOM on Phase 4 (an integral part of 2007-2009 Pay and Modernization Agreement). If he cannot provide reason why it is not actioned, question why CWU members should continue to abide by the 2007-2009 Pay & Mod Agreement that RM put so much faith in! If no suitable answer is forthcoming, give notice that you are going into dispute over the issue.
It is what happens at ground level that will dictate the path and result of this dispute - not the politicians, RM management and CWU leadership. The membership is fully aware that it was shafted in 2007 and will not allow the same mistakes to happen again.
Which is why it is so important that the membership shows strength in numbers on Thursday/Friday and its resilience to resist the inevitable aftermath of managerial aggression and be strong!
