DDA covered and 2nd stage warning

Hi i have had a lot of health problems since last December pain in hands and feet and now neck and shoulders, been to see some specialists and im still waiting on some results, anyways one of the doctors suspects a condition called fibromyalgia, which is a flucturating condition and causes bad muscle pains and makes you tired all the time, i have a lot of fibromyalgia symptoms but as i said could be something else, anyways i have found out that this and arthritis is covered by the DDA, now i have had my 1st stage warning and when and if i go back will have to face a 2nd stage warning, so if i find out it is fibromyalgia and covered by DDA does that mean they will have to disregard the warnings?

any advice much appreciated.

One can't say for certain that they should be disregarded, but they should definitely be reviewed with advice from Atos. However, I think you need to have had the condition for over a year for it to be covered by the DDA. The diagnosis can be retrospective, so it doesn't matter when you are diagnosed, it's the symptoms that count, but it would be up to the medical professionals to decide how long you've had it.

Thanks for your replies i found those links very interesting thanks, well i guess i will know the diagnosis soon as got hospital appointment in 3 weeks, i just feel worried about my job i actually really like my job its just the lifting that i can't seem to do anymore, i also feel like i have let Royal Mail down by having so much time off, i know a lot of you on here moan about the job but i have never had any problems there and have found everyone to be friendly, i just hope my health problems can resolve themselves but worried when i go back will have 2nd stage warning and if Atos make me go back too soon while still unwell will probably face the sack.

Atos are phoning me on Monday they said it would be a nurse i wonder how they can access you over phone without even seeing you and haven't even had results yet so are they going to try and send me back to work without even knowing whats wrong?

I think they may also take into account what medication you are on, the medication must help you lead as normal of life as possible and you will of had to be on the med for a certain length of time. With me i am asthmatic and have been so since the age of 6 and have been on meds for the past 30 years to control it and this was taken into account when i was given DDA for the condition but don't rely on DDA as some will try their hardest to still issue a stage whether you are covered or not. Also after you have spoken to ATOS they will send your notes to a manager, ask the nurse to add a message to them asking the manager to give you a copy of them you are entitled to see them.
