Accident on duty ? Mystic Meg Manager

Someone in our office slipped while on delivery. He badly sprained his ankle and went to hospital and is currently of sick.

The manager has sent him a nice letter informing him that he suspects that he was reading his mail at the time of the accident and therefore it was his own fault. Even though the manager was at home as he dosen't seem to like working on Saturday, especially the bankholiday. This now means that the absense will be counted as sick and not an accident on duty.

It seems that Accidents on duty do not count on any stage warnings.

I'm concerned as it means that every fall will be down to the postman/women according to our DOM. Also pegasus doesn't allow you to stop and read the mail before posting.

Is the Dom doing it to make his H&S record look better or is so hecan get rid of people easier !

Finally is he allowed to do it (another grivence coming up)

Any advice wecolmed

No wonder people vote yes when managers try rubbish like this.

The tribunal found the agreement with the trade union did not provide management with discretion to decide about absences caused by accidents at work.

The agreement said such absences must normally be discounted.

Maybe you could print off a copy and show it to your DOM and ask him if he would still be as confident in front of a tribunal.

Its quite obvious he was reading the mail, probably making sure he puts the letter through the right door, in future lets just take any mail and shove lots of random letters through peoples doors :Very Happy .
RM quality will probably improve :crazy:

The manager's a w****r,the acccident has to be investigated end of,the fact that the manager has sent him a letter with the above in is good,cause he's made himself look a twat.
Get the union involved and also get your colleage to put a grievence in.

How does that work out then? We dont have pegasus yet but we are told specifically not to read the next address while walking - which is why i cut of or claim on heavy days. Add a trolley to that and ill be cutting AND claiming.

What a load of rubbish 'the manager suspects that he was reading the mail', so what should this postie be doing just putting the mail in any letterbox? He may well suspect that the postie was reading the mail, however, common sense would indicate that for the manager to have come to such a decision he must have proof of the posties infraction. As he has obviously made a ruling based on this evidence perhaps the accused could have site of it, ask them politely of course.

However, if he has been interviewed as part of the investigation , I hope he has not said anything that could point towards the manager reaching this conclusion. Although it does highlight the need/requirement for a witness to be taken to any interview.

The biggest problem is that RM have no FLEXIBILITY towards certain situation, so in a office you may have a lot (skivers, chancers) every office has them, so everyone gets treated the same. The sames applies with stage 1, the manager could if he wanted to no give a stage 1 but 9 times out 10 he does.
So, clearly RM and FLEXIBILITY is nothing more than a sham. Flexiable to suit them but not the postman.

Surprise surprise our DOM used to do that too. He once tried to do a part timer for an absence due to injury after the APG crossed a footbridge over a rail line..that the DOM had dropped him on the other side of to cross! :no no

He didn't back down but if it had gone to tribunal they'd have been toast.

get the rep involved and the first question to the dim should be where is your evidence, he's trying it on stand up to him and dont be bullied.

Clear to me that the DOM is trying to turn a genuine AOD into a blameworthy incident (fault of the employee). And to coin a phrase, I would suspect that the DOM had his nose stuck inside a daily newspaper whilst supping coffee, instead of fully investigating the AOD and as part of that investigation what the actual condition of the surface was in where the slip and injury took place.

RM are being monitored by the Health & Safety Executive , their H&S policy on paper is very good but compliance is poor which gives them a problem to be " solved " . RM's " solution " was that accidents " suddenly " became incidents :crazy: . Somebody once came on here saying he'd worked in the Insurance Claims Industry for years and he'd never heard so much rubbish in his life .

The DIM/DUM will be under pressure from his idiots in charge to " massage ' the figures and to use " managerial " redefinition " .

The first thing to do is if anybody has a accident / incident is to report it as a Industrial Injury to the Social , that way RM can't close ranks and come out with such tripe . Also the HSE have been discreetly been tipped off about accidents in the past by staff.

RM won't like it , but it's not school or a prison ; it's a workplace . It's a offence to use detriment against an employee for valid H&S concerns and is punishable in a Industrial Tribunal .

Also make sure there's detailed diarized evidence i.e. who , where , when , whom etc , pictures taken on a mobile - whatever as primary evidence for a " rainy day " .

If you've got evidence , make RM work for theirs . - There are professional claimers coming the old soldier as previously posted but RM have to prove that .

RM are not popular with Tribunal Chairmen , too black & white , simplistic , judgmental , judicious , inflexible etc , etc . Cat & Mouse stuff - let's face it , the cat if you will ; is not exactly a MENSA candidate ? .

Mine initially refused to record my dog attack. They couldn't "recall" incident, at all.
Funnily, they altered their position later on, and did record it as AOD. Got evidence of them insisting I sign for Anti dog attack kit two days later as well.
The other day, I found a letter from Atos to Management, dated a few days after the attack, it said, "attacked, blah, blah, as you are aware." AS YOU ARE AWARE!!! They knew and denied it, more than once. Selective memory or what? Dept of Work/Pensions also agreed it was Industrial injury too...
I could get a job for my late Great Grandmother, who was Spiritualist, Palmist and Fortune Teller. She would fit in well with RM Managers.
