Fixed termers and Industrial Action
Heard some info conflicting on this. What is my position if I choose to join a strike? Could it be used against me when it comes to renewing my contract? That has what has been suggested to me (by other posties, that is) but I would have thought this was illegal? Not bothered either way as I won't cross the picket line no matter what but just wondering if they can get away with doing stuff like this?
You must understand that I am here purely as A BEARER OF MESSAGES.

I guess if you are fixed term they dont have to give a reason not to renew contract even if it was because of your participation in i/a.

Unfair Detriment for legitimate TU activity is a offence punishable at a tribunal - problem is proving itdeltaforce wrote:I guess if you are fixed term they dont have to give a reason not to renew contract even if it was because of your participation in i/a.
TC's & fixed terms were threatened with termination during London OIA & UIA in 2003 , and countrywide but there was a 1.8 % no vote in the National Ballot . Dave Ward condemned this as disgraceful bullying .

If it's any help. I took part in several Strikes in the '90's, before I was made permanent, and I'm still here. But as Norbert pointed out: It's very hard to prove that IA was the reason for failing to renew your Contract, if they try that. Although I'd expect that if they did, refuse to renew your contract. You're Collegues would be quick to rush to your defence.

What office do you work at? We have a guy who is on a temporary contract and I have advised him to go in during the strike,as I have no confidence that the members in our office will back him if they refuse to renew his contract.andy2007 wrote:If it's any help. may be able to prove it if RM couch things in vague / wooly corporate language i.e. " He takes it on himself / herself to get involved with matters of no concern " , " Always involved when there is incidents " which are union bashing terms purely to impress more senior managers .andy2007 wrote:If it's any help. It's proving " suspicious issues " with good prosecution ( to " nail " RM ) and getting a tribunal to draw it's own conclusions from so called " coincidences " / drawing adverse inferences .
RM slip up as their take on matters is a very black and white one and they act too judiciously .
RM tend to operate at the limit of employment law at best or practices are a bit "sharp" but there is a tendency to move the goalposts / put perverse interpretations on things .

Re: Fixed termers and Industrial Action
I started during the last round of strikes. I took this concern to my DOM who suggested i join the strikes. He even switched my days off to make sure I didnt lose any wage.
He said "We have spend alot of money recruiting you and dont want to give you any reason to leave because you start at a difficult time"
I still respect him for this.
