Harsh most definately, again though here we see the consequences of one instance of momentory madness by an employee with a 25 year unblemished record and the consequences of his actions in leaving his van unlocked unattended and engine running even for a short time space.

The employee concerned must have signed the integrity of mail form at his DO as each employee has to sign it on a six monthly basis. As we all should know signing the form in reality means that we have read the rules about integrity of mail and understood what those rules are.

I do wish him every success at his appeal hearing, but in the current industrial climate who knows! And again if he is unsuccessful at appeal and goes to Industrial Employment Tribunal for unfair dismissal, the fact remains did the employer act within the band of reasonable responses. The tribunal may accept that the postie was indeed guilty of 'gross misconduct' but dismissal did not necessarily require to follow as each case has to be assessed on its own merits.

The tribunal will have to determine whether Royal Mail had acted reasonably in treating the posties conduct as a sufficient reaon for dismissal. whether the postie had contributed to his own dismissal and what, in the event that it was determined that he had been unfairly dismissed, was the appropriate remedy.

All of course hypothetical conjecture until outcome of his appeal.

Again if you are asked to sign anything by RM managers make sure you thoroughly read and understand the contents of what you are signing.

On another matter have read that a postie axed over his absence record after he hurt himself taking a shortcut on his round won £5,000 for being unfairly sacked. Jamie McSorley needed 11 stitches on a leg injury after he jumped over a 2ft wall. His 3 weeks off triggered Royal Mail's absence management policy and he was dismissed as he'd had prior sick days. But a tribunal ruled he'd been sacked unfairly because absences caused by injuries at work were normally discounted. Mr McSorley of Hamilton, got £5,067 but was not reinstated. - Source: Page 15 Scottish Sun.

Are there any cases were posties have had their vans stolen and have kept their jobs because this posties van was not stolen, he should have had a written warning and if he does it again then dismissal. If he can find any cases regarding this it might help him at an employment tribunal. (is union rep should know this information in order to help his case).

Yes there was,and we were all suprised at the outcome,not 100% but i think he got his job back after an appeal.
Will have a look for the story.

If anyone needs a case study to help this guy then send me a pm-this has happened in my office,the van was stolen,recovered and the postman got off with a warning.
A bit inconsistent to sack someone else for a lesser "offence".

They have to show that they are consistent in the way they treat there employee's,to sack one postie & then just give another postie a warning for a worse offence, it will show the Tribunal that they are not consistent.Tribunal's are very strict on fairness & inconsistency's, I think this postie has a strong case & I am pretty sure the cwu will take it on.But unfortunately he has to go through all this political crap & stress for the next ex amount of months,I know exactly how he will feel, best of luck to him, I mean we all make mistake's. :arrrghhh

We have had cases where the man has been disciplined but not sacked and cases where they have been sacked, one case where the vehicle was "taken" without the keys apparently BUT no evidence to support that supposition - it depends on whether you are supported or not supported. It is classed as gross misconduct and is therefore instant dismissal subject to investigation, which doesn't take long in these cases.
