Well that's easily remidied. Don't arrange any more part day Strikes. Just do full day ones! And as for the existing ones: Get a "class action" together, to sue thm for wrongful witholding of wages!

I don't think so. But I've just put it on PMC too, for those who don't have an account here. The more people know about this, the better our chances of avoiding anyone being caught out by these dirty tricks. Just how low are they willing to stoop?!?!?

Don't it make you laugh when these dickheads try and take the moral high ground and say,"Our customers expect a decent postal service etc etc...." if only they knew the truth about how the Management were trying to F**k up the system just so they can get their poxy bonuses.

After reading this is ANYONE going to bother with a partial strike (never saw the use of a PT Strike anyway) glad we're balloting for Full Days strikes ASAP

The way I read this is if its not already in your contract, an employer CANNOT deduct anything from your wages - except that which is lawful i.e the hours of your strike action

You must be paid for the hours that you work.

They can of course alter the terms of your contract BUT they would have to give you statutory notice of a variation of contract( I think that it is something like 28 days notice ).

This 1996 act seems to say that they cant act retrospectivly and deduct from your lawful pay unless you agree to it

As properly balloted strike action is your legal right, I dont think that they can lawfully withhold all of that days wage if you have worked some of the duty

Maybe a CWU legal eagle could check this up

You're right. That's why I suggested a "class action" (at least I think that's the term for it) against RM if they actually dare to carry out their threat, for the part day Strikes that're already arranged. I'm quite sure that if every Postie who was affected, took part in the case against them. They'd cave in, for fear of the backlash from the Press.

Although from now on, it would be wise to avoid arranging any more part day Strikes.

So i suppose unless you agree to be a wage whore they think the can do anything they like!. With hold a weeks wages if you do not work one day or deduct wages if you work to your time or god forbid get injured doing the job and thus not do all the hours royal mail expects!. THIS IS ILLEGAL AND OUR UNION MUST DO SOMETHING NOW ABOUT THIS NOW!.

This is going to be really interesting when it goes to court, I'm personally up for it, take strike action for ½ day, have a full day deducted from me and go to tribunal to get the rest back.
Sometimes I wonder who's actually making all these provocative decisions and what they think they are going to gain by making them.

The fact that we are seeing so many desperate tactics from RM before we even get to a national strike leads me to believe that

1- these part day / rolling /multi office strikes are really hitting them hard and they are desperate to frighten everyone who's not striking at the moment to not join in.

2- they don't realise that the more they bully people with these tactics the more people want to strike. I have seen support in my office for striking go UP not down

3- I think they are probing us for any signs of weakness

Be very careful here, everyone.

Reading between the lines RM management are trying to get you to not turn up for your duty on the day of the part-day strike. After all, who is going to do voluntary work for that shower?

Then when you don't turn up for the hours you aren't striking, you are in breach of contract & they are within their rights to sack you.

And yes, they do have to pay you for hours worked. Don't forget, the CWU have to post notice of an intended strike.......that means the times that strikes apply, any other hours do not count as strike action.

are you based in a mail centre cos if this is the case you will have to finish your shift and the ones starting there shift at the strike time will not go in you dont cut off you finish your shift the strike starts at that time you wouldnt just cut off
