Curfew for postman over graffiti case

By GORDON CURRIE
A POSTMAN has been placed under curfew after being charged in connection with a series of "graffiti-bombing" incidents at a railway station.
Douglas Forsyth has been banned from leaving his home after 7pm after being accused of carrying out the late-night vandalism.
A sheriff granted Forsyth bail after he appeared in court yesterday, but told him that he would have to obey the curfew as a condition of being freed.
After being told that Forsyth was a postal worker, Sheriff Robert McCreadie allowed the curfew to end at 5am so he could continue working.
Forsyth, 19, from Perth, denied a series of charges related to vandalism in the town over a period of four months.
He denied that he maliciously spray-painted train carriages belonging to First ScotRail at Perth railway station on three occasions in September, October and December. The fourth charge alleges that Forsyth spray-painted a wall in the town on Hogmanay.
Fiscal depute Vicki Bell asked for the curfew condition, and told the court that there was a 75 per cent chance that a graffiti artist would return and commit more crime.
Solicitor David Holmes, defending, said his client was a postal worker who would not be able to carry out his job if he could not leave his home early in the morning.
He also told the court that a curfew would restrict his client's social life because he was a musician in a band with evening engagements.
However, Sheriff McCreadie said: "It seems to me that this is a course of conduct over a number of months and a curfew would be appropriate."
Forsyth, who will spend the evening of his 20th birthday on 15 January under curfew, will come to trial next month.

It's not the New York Subway
I'm surprised he's kept his job , bringing RM into disrepute , though normally RM don't need any help from their staff with that !.; they seem to mange perfectly well !. Their double standards always make me laugh especially after that kneejerk panic reaction after the Dispatches programme where staff were out through the door without following procedure .DirtyHarry wrote:Normally, I don't have much truck with graffiti vandals, but if young Douglas has been spraying the words, "Leighton's a w****r, Crozier's a p***k", all
over Perth, I'd consider standing him a pint.
I'm not the biggest fan of the Train Operating Companies , but the trains he sprayed are leased out from the Banks and they'd have to be taken out of service to be repainted . There's also the danger of going onto the railway to spray tunnels , bridges etc .

He might only have kept his job up till now because he hadn't told Royal Mail he had been arrested and was due in court.

if this is all over the papers , a area manager will read it and there will be pressure to get rid of him for bringing RM into disrepute .Lounge Lizard wrote:He might only have kept his job up till now because he hadn't told Royal Mail he had been arrested and was due in court.

Yes, that's what I'm saying, unlike someone earlier who implied that that he still had his job with RM knowing about it.norbert wrote:if this is all over the papers , a area manager will read it and there will be pressure to get rid of him for bringing RM into disrepute .Lounge Lizard wrote:He might only have kept his job up till now because he hadn't told Royal Mail he had been arrested and was due in court.

And why does it matter, that it'll restrict his Social Life. It's the price he has to pay for being a Criminal.stokes11eg wrote:So, a curfew would restrict his 'Social Life'what's that?

Sorry, my mistake. I misread the article.shadow wrote:The guy hasn't been found guilty yet. He could actualy be innocent.
It seems he's only on Bail. In which case, why the cerfew, instead of a monetary Bail. I'm not sure whether you pay it at the time, and get it back when you turn up to Court. Or pay it as a fine, if you fail to turn up. But I do know that you aren't out of pocket, if you don't run. Either way, surely that would have been a better option.

Re: Curfew for postman over graffiti case
AFAIK you deposit the bail money at the time its granted. This guy may have pleaded poverty and the court was inclined to allow a bail application, but not a free one. They may therefore have decided that the curfew was part of the bail conditions. Thats how I read it anyway.andy2007 wrote:Sorry, my mistake. In the UK (unlike the USA) you do not usually have to actually deposit bail money with the Court.
It is just a condition of your release until you next appear in Court. If you fail to appear you (or
anyone else who has stood as bail guarantor or 'surety' for your appearance) will then be liable to
pay the bail amount.
