Absence Process, now comfirmed as Harassment
Hi,
My story continues. . .
Just phoned the work and told the DOM that due to pain and immobility brought on by my back and sciatic problems, I couldn't make it to the Managment Interview he wanted to do today. I told him I would be happy to talk to him on the phone about any of this or, if he HAD to see me, then he could see me a home.
He then told me was "Hovering". I question this and he said that he thought I wasn't as bad as I made out and that I could be working. H then told me he would put a Stop on my wages and send me to the RM doctor. (This is in spite of the two week doctors line I have).
I'm taking out a grievance against him in the next few days, but we all know how inefectual they are. (Check out the news article I found - I've actually had dealing with that fudd and zero happened)
On the upside, my stressedoutness has been replaced by pissedoffness. Just need to cultivate it a little.

shop him to the Health and Safety Executive , two can play that throw the rulebook at people game , this " holier than thou " RM arrogance is breathtaking .
RM arrogantly think they are a state within a state , what might be acceptable in North Korea or China , is not acceptable in the real world UK

What a cock that DOM is.
He has no right to threaten you with stopping your pay(especially after being signed off work) and you could take this all the way to a tribunal for loss of earnings if he does so.
He`s also trying to scare you with the RM doctor, big thrill....let them send for you,the RM `doctor`in many cases will be a jumped up nurse who`s done a course in occupational health, even when they do actually manage to get a `proper`doctor to assess cases they are only of a similiar rank to your own GP and will be very reluctant to call into question a fellow GP diagnosis.
Going the grievance route is right,I would also advise you ring the cwu harrassment line if you`ve not already done so.020 8971 7380 or 020 8971 7593 is the telephone number or email: cwu-helpline@cwu.org.

Royal Mail managers.....about as popular as a t.urd in a swimming pool!
The DDA/Equality Act demands action,NOT words......adjustments NOT Occupational Health referrals.Case No:2505901/09
Royal Mail is an Equal Opportunities Employer..It discriminates against everybody.

obviously record and log everything - there's DIM DUMS that have gone white as a sheet when that's happened - all good stuff for a " rainy day " .General Mannerheim wrote:What a cock that DOM is.![]()

Going to the CWU harassment line is good advice - builds up a paper trail .

apparently the line is for National Insurance & Social Security purposes though the doctor theoretically would stand up in court with it . It can be overruled by someone acting for RM of equivalent or higher rank NOT "Dr" DIM DUM .eian687 wrote:i thought doctor note was a legal document

just a point of clarity in regards of "rank" - in terms of at an employment tribunal an occupational doctor (aka ATOS doctors) view on a medical condition carries more weight than that of a standard GP. The thinking is simply that whilst both are professional doctors, the occupational doctor "understands" the job of RM employees, hence applies his medical knowledge to this and makes and assessment on ability to undertake royal mail work or not. Most GP's consider the ONLY role of royal mail is with a heavy bag on your shoulder walking the street.

the inverted commas bit is very apt - I've had to explain RSC's , bags , trays , yorkies , coffins , alts & DBF's are part of your normal working day , slightly different from justsnoopy777 wrote:just a point of clarity in regards of "rank" - in terms of at an employment tribunal an occupational doctor (aka ATOS doctors) view on a medical condition carries more weight than that of a standard GP. Re: Absence Process, now comfirmed as Harassment
this happened to myself last year, still got the threatening letter i recieved to say my dom would be ceasing my pay if i did not start back on his specific date, i started on this date, as i had already being on half pay for 2 months, "yes guess what" recieved a stage 1, even though i explained i was still in agony and needed further surgery, a week later met my consultant which HE said i needed further surgery, offered the surgery the week after,"had to refuse due to this threatening letter," 6 months later got a call off my consultant secretary inviting me for a cancellation surgery a few days later, explained i had to have the managers permission, so i asked the manager, which i recieve the permission, off then for a few months recovering, yes went back, and i recieve a stage 2 for this absent, tried to put a grievance in, it gets refused off the area manager, what chance have we,General Mannerheim wrote:What a cock that DOM is.![]()

OK lets look at this another way.
What would happen if after your GP or specialist had advised you to refrain from work obviously because in his opinion that your not fit enough to work, then Atos ring you up with one of their `remote viewing` telephone consultations and decide that your fit to return to work, you go back to work and have a collapse or even worse you cause somebody to have an accident... what then??

What a complete set of tossers we have as managers, uncaring pillocks who in my experience where not very good postmen either.
You need a paper trail and get the rep involved asap, now you have a problem already as he is going to deny the phone convo with you for a start. If you have a sick note it covers you and states that you are not fit for work by your own GP, he has seen you the RM ATOS one has not. Also the sick note technically stops you from working as well, suppose you go into work and have an accident as a result of your back. You will be found at fault for being at work when the sick note says you should not be, time was no firm would let you back into work until you where signed fit. The manager will almost certainly slap a stage one on you so you may as well stay off until you are 100% right, going back to wrok early could give him two bites of your cherry.
I have been going through a grevience stage with a stage one, they messed up big time but it has now been going on for over five months. I was due the final appeal stage decision six weeks ago, still waiting and HQ have it all now, they really do not care. They only pay lip service to being fair and even handed, there are some decent managers, but they are very thin on the ground and getting thinner weekly.
Don't give in to being bullied or harrassed, fight back , you may lose but you can keep them busy with interviews, meetings , appeals etc that alone is worth it just to hack them off.

Re: Absence Process, now comfirmed as Harassment
the only way is take things outside the PO & report that jumped up idiot to the HSE so they can't close ranks , as for being " underhand " by recording things , RM would come out as being underhand not the postie for trying on all this verbal bullying in the belief that there was no witnesses .the one wrote:this happened to myself last year, still got the threatening letter i recieved to say my dom would be ceasing my pay if i did not start back on his specific date, i started on this date, as i had already being on half pay for 2 months, "yes guess what" recieved a stage 1, even though i explained i was still in agony and needed further surgery, a week later met my consultant which HE said i needed further surgery, offered the surgery the week after,"had to refuse due to this threatening letter," 6 months later got a call off my consultant secretary inviting me for a cancellation surgery a few days later, explained i had to have the managers permission, so i asked the manager, which i recieve the permission, off then for a few months recovering, yes went back, and i recieve a stage 2 for this absent, tried to put a grievance in, it gets refused off the area manager, what chance have we,General Mannerheim wrote:What a cock that DOM is.![]()
