think it's based on the European Working Time Regulations - prior to that , if you worked for a agency or some sort of casual as required work , you got absolutely nothing , AFAIK they also brought out the 48 hr limit and the " voluntary " opt out :Very Happy etc .

Some firms watered down the holiday allowance by doing a bank holidays fiddle , I think ? that was stopped .

I think you'd have to go well over the managers head and state your grounds to HR .

As far as I understand it, agencys have had to pay their temps holiday money for a good couple of years now. So the woman of my dreams tells me, who I live with, she was temping about 5 years ago and got paid annual leave, albiet 20 days a year including public holidays. You would have to check this out. But if you are a member of CWU, I'm sure the Employment Law dept could clear this up with one simple phone call. Also anybody on a 30 hour contract who was averaging 40 hours, should be able to claim unpaid A/L etc etc.for the missing ten hours. Let the media focus on this point of employing people for 40 hours a week and giving them a half days holiday for their effort. Things look bad for bonuses now! Could you boys/girls start a whip round at your various locations. And for any dims, are you trading down from a BMW to a Smart car? Is it Skegness and not the Seychelles next summer? :Very Happy

I'd to do agency temping in 96 / 97 , if I remember rightly there was a bit of a recession on so you'd to take bits and pieces ; you certainly got nothing in the way of paid holidays .

I did go to a New Labour Meeting ( OMG I must have been naive or too idealistic - LOL ) when Ian McCartney was the speaker . Apparently the Working Time Directive was stopped by the Major Tory government as things like the national minimum wage would destroy jobs . I think ? the EEC Socialist Group pushed for New Labour to accept it , however they didn't exactly champion it and it was the most watered down version of the Social Chapter that the likes of the CBI would accept as New Labour had to appear business friendly .

A direct quote from the ET
5. I am satisfied that the claim succeeds and those moneys should have been paid or the Claimant should have been disciplined in the usual way. I am also satisfied that the holiday entitlement is calculated correctly pro rata on the hours worked and in accordance with the minimum statutory provisions, either applying the Directive or based pn Part II of the Employment Rights Act 1996. I cannot believe the Royal Mail would seek not to pay someone or compensate them for holiday pro rata where they were in fact working considerably more than one hour per week.
Tell them that and see how they react.

It's good to get these types of threads, the ridiculous my manager said bollox, so we can reassure ourselves that while the world is falling apart, Royal Mail managers are still being the low-life C***S they have always been.

who in their right mind would accept a 1 Hr contract with all the abuse they will get for it, it would be more cost effective to stay on the dole than the uncertainity of 1 Hr contract being at their beck and call like that, its a Managment licence to abuse and exploit workers.

On another note

In my work location they are trying to encourage staff to buy down their hours such as 36, 30 and 24 hours, some wants to buy down so they don't have to do any sorting, I guarantee that once the buy downs are completed, they WILL be back on sorting whatever hours they are on then when the walk sorting machines come in, overtime will be reduced the sorting they will eb doing is boxing them in fitting and all they have to rely on is the buy down hours, their pension will suffer in the long term.

I have refused to buy down.

when i went for the job i was told their were 4 jobs 2 33 hr contracts and 2 1hour contracts, i wanted a 33hr obviously but was asked if i would consider a 1 hour contract and also informed that i would more than likely work 33 hrs anyhow and get a 33hr contract within a month or so, so i said yes, mainly to show a good impression for a potential employer.

I was then informed via letter that they would like to employ me in a 1 hr capacity, i was never told anything about the lack of holiday pay they are getting screwed with and utterly shocked and discusted when i found out. im on a 24 hr contract since january and cant see me ever getting a 33 hr contract as they are constantly reducing staff numbers/hrs.

so basically what im saying is that not all 1 hrs join seeking a job on a 1hr basis.
