RoyalMail Hr admitting 1hr workers entitled to holiday pay

Just thought i'd give royal mail hr a ring to see if i could get a decent response out of them regarding the holiday pay i never received while on my 1 hour contract, basically after the advisor speaking to her advisors, i was told that i can claim back what i was not paid by getting my manager to work out what i should be entitled to in 12 week blocks and putting it on the pay system, i take it that they would work the avg hours per each 12 week period and pay this based on a 1/4 of the 22.5 hours statutory holiday entitlement ie 5.625. I will speak to my manager when i go back in from sick leave and see what he has to say about this, im sure he will make this a lot harder than it sounds, but at least it looks like staff will duly get what they deserve!

thanks whitmoore its probably down to your tribunal that they have now changed their policy!

I don't think this A/L calculated over a 12 week period is anything new, because this is what I heard of off HR very soon after I started. But whether HR had informed DOMs of this, but they chose to ignore it (Surely not) is open to debate. Ater all we are talking budgets and bonuses here. All I can say is the Evershed brief vehemently denied I was due anything other than A/L based on a one hour contract, which equals just over 0.5 of a day per year. Also if you go sick for a fortnight of the 12 weeks,are you still accruing A/L? over 12 weeks or 10? A full time postman doesn't loose any entitlement to A/L because he goes sick, so why should part-timers? Hang on, I'll stop there, I don't want to give them any ideas! The same should apply to bank holidays and special leave. What my Dom and Eversheds brief told the ET is that I only had to work one hour a week if I wanted to, but we all know the intention of the one hour contract. This is something for WalMart school of business, give them short contracts, pay them up in OT but if they start messing around (going sick, asking for the correct holidays or just being a general pain) then stick them down to their contracted hours as punishment.

Yep, I do not want to give away my location but I was on a small contract for around 8 months. This is exactly what I thought.

With all the spokesmen Royal Mail have got that spout what a great company Royal Mail is, doesnt it disgust you that they can stick someone on a 1HR contract knowing they need them for 40+ hours. Just so they can rape them for their rewarding holiday and entitled sick pay.

It's not a present having a decent holiday it's a bloody justified right!

so basically the dom will try his hardest not to pay it as it comes out of the offices budget/his bonus then?, cos it will be like 5k at least from my office lol :crazy: , the dom has had a letter off hr saying in future that holidays have to be calculated in 12 week periods, but whether he believes this for the past is another topic, hr did say that he should ring them if he has any queries/problems with this!

Does this apply to 30 hour contract also. i.e if someone is working 40 hour weeks but only gets 30 hours pay on leave.

it should do but i very much doubt it, they would definitely pull the optional overtime as the 30-40hr gap, whereas the 1 hr contract is a supposed get ure foot in the door contract, basically its a legal minefield and best to get hr's view on it for a start.

It certainly is ASDA / Walmart stuff :lfo :cfo , what their staff do is apply for housing rebate , tax credits , whatever off the social based on flat PT hours , then pile on the overtime UNTIL the next time they are to be assessed by whoever .

So effectively the state subsidies these firms as in the States . Walmart have had a bad press but they've a propaganda machine that Albert Eichmann would be proud of , just like RM :no no .

However if they duck for whatever reason , they're on a O/T ban for a fortnight . Very regimented there with a culture of fear just like RM .

This idea was first muted by that propaganda plant on the Hellmail forum , some of you will know of him from 2007 , another idea was a mum's army :crazy: as they won't moan

We have just found out that my son who has worked for 7 years on a saturday contract which was put up to 2 days for around 2.5 years had never recieved any credit for bank holidays ever which he was entitled to,the read out came out as 18-19 weeks owed,his manager has just said to him today he does not know what to do about it yet but it turned out he was hoping my son would leave before he found out,it turned out the DOM knew about it but he was also hoping that he would go before he found out,it has really annoyed me because he has never let them down,never been sick and has taken his degree all at the same time yet if you took a managers holiday away or did not bother to give them what they were entitled to they would be the first in the line shouting

this wants leaking via a friend of a friend , because it's all tied in with budgets so naturally there is the temptation to fiddle people out of holiday pay . However who is responsible for this 1 hr idea and who encourages this dishonest culture ? :lfo :cfo - it would also be good propaganda for the union too ?
