Facts on the failed attemept at an injunction by RM

Post by Martin Walsh »

The victory in the high court yesterday afternoon was one of the most important this union has ever had. There is no doubt had Royal Mail been awarded an injunction then all the ballots we have currently and all those which have been requested would have been put on hold until a full hearing.

Royal Mail`s argument was on whether the union could ballot a whole building ie Mount Pleasant which has processing distribution and deliveries within it all together. There argument was if the union had balloted previously on functions then it could not change . In addition they were arguing that if the union could ballot a whole building then the previous ballots which balloted separate units within one building ie Camberwell delivery office , and Camberwell hub was wrong and that the injunction should be put on all ballots.

The CWU represented by John Hendy QC and supported by Patterson Brewer our employment solicitors argued that it was down to the union who we ballot within a building provided we supply the numbers in line with our legal obligations.

The Lady judge refused Royal Mail the injunction and when they asked for an appeal she said no and also added that I am awarding costs to the CWU and said to them you are completely wrong.

The 14 Royal Mail managers who attended were absolutely gutted as they had expected to win.

So what a victory for the CWU

They could have guaranteed a 3 month injunction by simply talking to the CWU.

But no, RM waste valuable resources by going to court. Infuriating.

Don't think I should say owt ,but our resident mod will most likely delete it anyway on the grounds of being far too seditious or possibly offensive to a distant relative of one of those disappointed managers.
Nice one Dingo ,but ffs what have we come to. We find ourselves cock a hoop cos we somehow managed to navigate a set of laws drawn up to make acting in defence of your terms and conditions illegal. Pathetic,Mandy will get the law changed and next time we'll be scratching around for a legal loophole again. Don't know about the rest of you ,but me, I'm fed up of playing the game by their rules,It's my ball,I
do the graft ,the parasite politicians on their fat freebies and the fat cats creaming off my wages in bonus payments can get stuffed. Time we made the rules ,after all we do do all the work.
There you go edit man ,edit away :chuckle

Reason: TBT edited out the personal bits - come on mate free speech is fine and dandy but personal comments because you disagree with a mods decision No

We have our own private forum for the Mods and Postman and I PM each other so AFAIK yes we do for major breaches of rules, or discussions where we need advice from other Mods just in case we are worried about being too leinent or going too far the other way.

Sometimes we don't need to post anything in there and can use the Edit feature like I did on your post.

Hope that answers everything. :Very Happy and thanks for giving me the chance to explain the mechanics behind the scenes. :Very Happy

It's good to get these types of threads, the ridiculous my manager said bollox, so we can reassure ourselves that while the world is falling apart, Royal Mail managers are still being the low-life C***S they have always been.
My BFF Clash
The daily grind of having to argue your case with an intellectual pigmy of a line manager is physically and emotionally draining.

Quite agree no problem at all with Teebs editing ,didn't twist the meaning of the post at all and the bits that came out were meant to,so it can be done.
Not the bit of the problem I was alluding to . If you intend to manage a site where not one comment is permitted that may possibly offend a single person member or not ,living or dead, then you will be very busy indeed and I would have thought publicizing the views of a party dedicated to promoting racial hatred would be a definite no no. Just that the general direction seems to be going off at a tangent to your original thrust and who needs two Postmanchats? Maybe its all as intended ,if so I apologize for any misunderstanding
