If you are a member of the Union then contact Simpson and Millar - through your rep - they should be able to point you in the right direction. Not being funny ,but before you go to a tribunal , you have to exhaust the RM grievance procedure first to give RM a sporting chance ( yes ! it's cr*p but ! ) , otherwise RM will twist everything round and make you look like a troublemaker that is too trigger happy . Secondly RM will be as obstructive as possible to wear you down , however if some idiot in charge comes out with a load of old b**locks , keep that as evidence ; give RM enough rope to hang themselves with
If the Union are on the ball , they'll use that " creative accounting " scheme as good propaganda against RM ; i.e. " testlettergate " to make RM's senior management look like a bunch of spivs that are cooking the books .
Finally RM usually buckle if a " friend of a friend " leaks things to the media as they can't close ranks and try and make sh** shine
Remember in that tribunal case , RM defended their senior managers and subordinates to the very bitter end , it was laughably pathetic but that's RM

anyone good with maths?, basically i can account for 1014.65 hours i worked under a 1hr contract, i know that every 10.2 hours worked i am entitled to 61mins holiday pay, so how many hours am i owed? also if this number is multiplied by say 8 pounds what cash figure am i looking for to claim back?, cheers if theirs anyone good with their sums lol

If you averaged 35 hours per week over a year as a new entrant, you would be entitled to 35/40 ths of 4 weeks 2 1/2 days, ie 7/8ths of 22.5 days at £8 per hour.
22.5 x 0.875 x 8 ( hours a day) x £8 = £1260.
Have a stab at bank holidays along the same principle, I missed the boat with my timing but the Judge thought there was something in it.
By the way, expect the full works and no expense spared when RM defend it at an ET.

Based on your figures:
1014.65 / 10.2 = 99.475
therefore
61mins x 99.475 = 6067.975 minutes or 101 hours roughly
so £8 x 101 would be £808
However this is based on the figures you provided and Whitemore is most certainly the expert on this and his formula would be the best one to use if you have all your figures to hand.

i contacted my local mp about the 1 hour contract and he is alledgedly going to contact royal mail regarding this and check on the legality regarding holidays etc,, whether he does or not is another issue, he's labour after all :cfo

Exploitatation of any worker is wrong, and before you ask, I am in no way a militant left winger. I just hate having the piss taken out of me or anyone else for that matter as far as working conditions go.

RM have always operated on a treat 'em mean , keep 'em keen basis , at one time people could be on cassie contracts for 18 months , or TC contracts at best , there's been a lot of division and a rigid staff hierarchy for a long time but 1hr contracts was taking the p**s .
I'm convinced that bright idea came from on very high :cfo :lfo and it was done quite deliberately , they'd this idiot who was supposed to be a DUM
Things never go away with RM , they just stay on the backburner .
No wonder they went into the usual panic mode and used Eversheds
Spivs , shysters , charaltans and brylcreemed gangsters .

I have knocked up a simple spreadsheet which shows what a postman on a 1 hour contract would be entitled to if the reality was that he was working 40 hours a week less the annual leave that he will be paid for the 1 hour contract. I think I,ve got the hourly rate right but it doesn't matter because you can just go in and change it (D5)as you can with your average hourly day(A5.) Only you can work out your average hourly day from your payslips, even if you've only got your last one as it will tell you what you have grossed over the current finanancial year.
I have no idea how many 1 hour contracts there are nationaly but for arguments sake, say there was 100 postmen on a 1 hour contract regularly working 40 hours a week, then I would say they would have to pay 100 x £1354.86 which is in excess of 135 grand. Gives me a warm glow in my belly that one.
You could almost certainly apply this to your 8 days of public/bank holidays, but as far as I know it has not been judged in an ET.
