Royal Mail and the one hour contact

Just got back from my employment tribunal with the Royal Mail. The employment judge said that my one hour contract was a farce and didn't reflect the reality of the job. I got back pay on my annual leave based on an average of 35 hours a week that I worked instead of the 1 hour contract. I also got paid for overtime that they refused to pay me above the 40 hours. The 2 managers faces were a picture as was the Eversheds solicitor. I am no longer a postie and did this off my own back. This judgement in my favour could have far reaching implications for part time and especially 1 hour contracts. Go and get whats yours boys and girls. By the way the managers lied a bit. They swore on the Holy Bible. I think they might not be going to heaven.

Do you have a link to the tribunal decision because it could lead to a class action against RM for every PTer who works 40 hours but is sharfted over holiday/sick pay.

Salute you sir Lots more details please,the implications of this result if verified are massive for all those on less than full time contracts who regularly perform OT.
Were you a CWU member?
Even if you were not, why has our union ,with a paid up legal department not advanced a test case on this issue to my knowledge to date?
If this judgement is reported accurately and upheld (as it should be) then RM's new delivery model is blown out of the water

hmm id be interested in hearing more, i was on a 1hr contract until january (now 24hr) and was constantly at loggerheads with them about holidays/overtime and the legality of this contract, when i really started complaining about it, saying that what they did was illegal and citing government legislation i suddenly was offered a 24 hr contract, this may have been coincidence, i reckon they owe me about 500 quid.

Obviously ,having been dragged through the "legal' process ,you will appreciate the need to dot the I's and cross the others,any info you can provide regarding this case would be an enormous boost to our brothers and sisters forced to exist on PT hours or bullied into cheap labour OT.
If confirmed,this really does raise some very serious questions about the quality,effectiveness and possibly the true nature of our union representation It's not a confused issue, it's not a minor one,you can't overlook it FFS.

Like the others, would like to see details of the ET ruling. If it sets a legal
precedent it will mean RM's plans for a part time disposable workforce without
rights to decent sickness/annual leave and pensions are dead in the water.
And best wishes to you in whatever you're doing now. Hope they treat you better
than RM.

Add: Wouldn't be at all surprised if RM takes it to Appeal though.
