removal of nightshifts

Post by mallyjames1 »

we get about a hundred yorkies of mail ,flats and packets during one nightshift.the area manager wants to abolish the duties of the 3 people who basically are a presentation team, putting all the trays and bundles on the fittings.is there anything in the fire regs. that all main doors have to be clear. the reason for me asking is that after the third wagon (15 yorks each) the inside area would be packed to the roof, blocking both entrance doors.a really pointless flawed plan because we retain our nightshift all. for 3 years so they are not saving any money.would the building be secure with no gateman.?any advice would be most welcome.ty

leak that flawed plan to either the Council Environmental Health or the Health & Safety Executive , the alternatives would be keep it in house and tell the Union H&S rep and let him deal with it , or send evidence of the possible obstruction to the HSE or Council Env Health and you can guarantee the Fire Officer will be round for an inspection and if he sees those doors blocked , he'll issue an improvement notice to be complied with otherwise he''ll get the place closed down as RM won't have a safety certificate anymore :hmmmm

That AM will lose a lot of Brownie Points if that happens . Careful how you go about this as there will a lot of sulking , territorial & :Boo hoo! vindictive managers looking for the " grass " :d'oh! :arrrghhh

When our night shifts finished and thats about 4 years ago now - the night shift workers had to chose the early shift duties starting at 0330 or woould have lost their allowance - that was the message from the union - because if they chose a later starting duty the shift allowance was gone because they had chosen a later start and not been placed on it.

as far as i know they have to either pay the allowance untill i retire because i've turned 50 or offer me a 1 off payment which i dont have to accept. i can't really see them taking it away by executive action as it was all part and parcel of the way forward. they can't now start picking which part's they do and don't want to honour. but like i've said they might offer a 1 off payment.

Yep the exact quote from the Way Forward Agreement (which is in downloads) says
Paragraph 5.5 deals with protection of pensionable allowances for employees
between the ages of 50 and 60. Individuals in this category would continue to
receive pensionable allowances, plus the non-pensionable element of RMSD
night shift payment until leaving the business or reaching pensionable age.
There is thus a maximum of 10 years protection for over 50’s in receipt of
pensionable allowances which would otherwise be lost as a result of
redeployment following a surplus situation.
and Para 5.5 says
5.5 Protection of Pensionable Allowances – Employees aged 50
or more but less than 60
5.5.1 Employees who are aged 50 or more but less than 60, whose new job
attracts a lower level of pensionable allowances (and non-pensionable element
of Service Delivery Night Shift Allowance if applicable) than that received in
total by the employee in his/her old job and, at the date his/her job ceases, the
employee has been fulfilling a role to which these allowances applied
continuously for more than six months, then he/she will continue to receive the
difference between the old level of allowances and the new, as if they were still
carrying out the previous role. This protection of allowance will continue for a
maximum of ten years or until the employee is aged 60 whichever is the earlier.
5.5.2 Where the employee had been fulfilling the duty attracting pensionable
allowances in his/her old job on a rotation basis, payment as set out above, will
be made on a pro-rated basis.
5.5.3 Employees will be expected to take on responsibilities in the new job
which attract equivalent pensionable allowances to those earned in their old job
wherever possible.
5.5.4 Any entitlement as a result of these protections will be set off against the
amount of any increase in the employee’s pay, which the employee enjoys by
reason of redeployment into the new job.
