Advice needed on being refused overtime pay

So, my boss had me in the office last week to say that my overtime was excessive and that he wouldnt be paying me all that was owed.

I pretty much laughed in his face and told him to "try me"
Lo and behold, my wages from fridayare missing a good few hours and the union is not intrested. We have no rep in our office and our area rep is mates with the D.M (go figure) The last time I went to H.Q, I was told that someone would get back to me. After 3 e-mails and about seven phone calls, I conceded (anyway, I did finish early a few days, so deducted the time owed from that)
I have basically told the D.M that I will not be working another minute over my time, so I have been promised a prep test first thing tomorrow!! :dance

In the meantime, I could do with some advice from those that have been in this type of situation before.

PLEASE PLEASE dont tell me to flag it with the union rep / area rep blah blah.
As far as I am concerened, the CWU is dead and buried and after my previous experiences with the union, it is a complete and utter waste of time!!

What to do if you haven't been paid in full:
If you haven't received your full pay (or any pay) try these simple steps:

Check your payslip to see if it tells you why you haven't been fully paid.
Check your contract to see if there is anything that allows your employer to make deductions from your pay.
Speak to your employer to see if you can sort the problem out with them.
If you have an employee representative (for example, a trade union official) you can ask for their help.
If this doesn't work, you have the right to go to an Employment Tribunal to get your money. You can also try and reclaim money you've lost (including the extra losses caused by you not receiving the money on time, for example, bank charges) by making a breach of contract claim.

Legal action
If you can't sort the problem out with your employer, you can decide to take legal action. Think carefully before taking any legal action against your employer. Ask yourself what you want to achieve and how much it will cost.

Remember that you'll only get compensation (called 'damages') if you can prove real financial loss (for example, if your employer doesn't pay your wages) - there's no compensation for distress or hurt feelings. Because damages will only reflect your actual loss they're based on net pay (that is, after tax), not gross pay (before tax). Also remember that taking legal action might prompt your employer to take out a counter claim against you if they feel they have one.

If you are a member of a trade union, it would be a good idea to speak with them before taking any legal action, as some unions provide a legal advice service for their members. Otherwise, you could talk to a solicitor, or discuss your case with a Citizens Advice Bureau adviser.

Looks like you are a wage slave, the emphasis not being on wage. Union ,whats jt for?

Its illegal for the company to not pay you for o/t worked. Simple as that!

:nana Yes. it is illegal, and if you live in Scotland--you could legally impound goods to the value of!!!

has it happened to anyone else in your office? if so it might be to your advantage to pool your resources and although you might have to do your complaints seperately ,see him on masse.either way doms hate paperwork,good luck.

its almost like doms have a check list to give to thier superiors and booking of o/t is deemed as an ineffiecent way of working ,our office budget for 2009/2010 is based on the none booking of o/t so good times ahead.

Well some time ago about 4 years an afternoon collections driver was told that he had to leave the job he was doing and do a scheduled collection duty in addition to the collection already on the original duty - he asked if he would be paid for the extra work and was told he wouldn't - he then said he wasn't feeling well and went home "sick" - the manager at the time said he had abandoned his duty and didn't pay him - cut a long story short he went to the union and threatened to take them to a tribunal - after some weeks they had to back down and pay him.

Take your break and do your job too the book inform your manager with a witness you can trust that you cannot complete within your time!. Good luck too you i was in the same situation as you once is my old manager at your office?.
