An employment tribunal has ruled that Royal Mail must reimburse pay it docked from postal workers last August after wrongly penalising them for carrying out unlawful industrial action by working slowly.

The ruling, made by the Croydon Tribunal Office at the beginning of September, means Royal Mail must pay 27 workers at its Streatham delivery office up to £170 each in return for pay that it refused to give them last year.

The postal workers, who were represented by the Communication Workers Union, made a claim against their employer after they had been docked up to two days' pay shortly after taking part in a union campaign called "Do the job properly".

As part of the campaign, postal workers were encouraged to attend work on time rather than coming in early, take proper meal breaks, and not to carry heavy bags or use private cars to deliver mail. The subsequent build-up of mail prompted Royal Mail to punish staff by docking their pay, accusing them of being on a "go slow".

Kathleen Healy, a partner at Freshfields Bruckhaus Deringer, said that under the Employment Rights Act, employers could deduct pay only if they had received clear consent from the employee to do so or if there had been an accidental overpayment of salary.

"You always have to check that you know what your contractual rights are when you are thinking about deducting pay and you also have to think about the right of employees not to be discriminated against on the grounds of trade union membership. It can have a negative publicity impact if you get it wrong," she said

Postal workers' union CWU has secured payouts from Royal Mail for 27 workers who had their pay docked after taking part in a safe work campaign. The 27 postal staff at London's Streatham delivery office had up to two days' pay stopped after participating in a CWU 'Do the job properly' campaign in August last year. The campaign encourages workers to attend work on time and not come in early, take proper meal breaks, not carry bags heavier than agreed health and safety weight limits and not to use their private cars for delivering mail. Dave Joyce, CWU's national health and safety officer, said: 'A culture of ignoring health and safety had developed in these offices and others where poorly trained local managers with an inability to manage health and safety as part of their normal activities meant that unsafe working went unchallenged because the sole focus was on productivity targets.' He added: 'Hopefully the new leadership in Royal Mail Letters will now work closely with the union to change this round and improve safety standards.'

I think that the CWU are trying to guage the likelyhood of having national action on executive action, so by balloting all the offices individually as it happens to them. If every office stands tall and votes for IA then it will give HQ the confidence to go for a national vote. Royal Mail think they are being clever by putting imense pressure on staff and reps. (see PETITIONS,PETITIONS, pETITIONS thread). Lets not let the b*st*rds get the better of us remember the union is our union so stay strong

non cooperation at ayrshire offices in mess all working o-time ptime in early cos full time cant cope not enough staff
mail going down ha f***** ha council tax towmrrw cutting off sat managers havent a clue no office duty plan hit or miss every day

10% savings in glasgow MC .....managers telling staff that the "proposals" are coming in next week wether we like it or not,but on the plus side our acting area rep.is (not forgetting our other reps) is doing his best to counter act this ,should be fun next week :crazy: :crazy: :crazy:

dundee central caved in and its a shambles.

east told union and bosses to poke it, same as west office.

nothings happenin at the mo, as we still dither to change our rep, boy, senior reps are making it difficult.

Meeting on a sunday at noon, at an ice rink!
And all 27 signatories of vote of no confidence must attend :hmmmm

Here at Dundee West we have been told that the executive action will come in on Monday April 6th. ( This was at a team brief last Wednesday the 11th.)
Meeting In The Celtic Club on Monday 23rd March @7pm.

here in the Lothians we're getting it enforced upon us in 4/5 weeks, i must say though the vast amount of staff here sound like they couldn't give a toss, they'll bring in the longer duties, people will still come in early to get prepped in before they go to the IP, they'll still work through their break, still run round their walk? in the hope of finishing early.
there are a few voices but not enough,
the i'm alright jack is the opinion here :arrrghhh
but....................................when the going gets tough they are the first to moan at the union for not doing anything.
