i would tell them i will be taking the last days before the cut off in any due days
if they cant give you time off then why should you lose out?

It seems that it's not our DIM is the only 1 that says that you lose the odd days left from this years leave allocation. It seems to me that an ML1 obviously has a degree in thickness to get that far :no no Under the way forward (2 steps back) agreement you can carry up to 5 days to go towards next years entitlement even if you purchase extra leave. Same thing happens in my spud office. When you would like a sat off it always comes back as a big fat NO!!!! IDK :hmmmm

You are legally entitled to any holidays that are due. These holidays are in your pay & conditions contract that you signed when you joined RM. If they refuse your request for holidays then they will be breaking your contract and could be sued.
You are allowed to carry over 5 days with the permission of your manager (Get it in writing). Under exceptional circumstances you can carry over more than 5 days but it must be done in writing by both you and your DOM.
If they refuse to let you carry anymore over and will not allow you any annual leave between now and the end of March then I would put in a grievance about this and also contact your rep if he is any good or the area rep if not.
You will win this grievance because RM are in danger of breach of contract if they dont deal with your holiday issues.
We have been having that problem in our office but on a much larger scale. We have got a new temp manager in alongside the assistant dom and they are trying hard to fit everyones holidays in but they are giving permission for anyone to carry any due days over also to help them out.

I am due 12 days which I have always been refused when I put in an annual leave form. I have now been told I am NOT allowed to have these holidays as they have no spare places. Personally, while a little interesting, the fact they do not have enough cover has nothing to do with me and I still want these holidays.

I plan to have another word with my manager and if not happy my union rep.

Get it in writing mate. Even if you trust your lino, what happens if he moves on and you get another who doesn't know anything about it. At least in writing you have the proof.

I can't understand why they could not just pay you for any leave that is not taken. Surely this would make more sense for those that do not want to take any leave that has not been taken. It would also make things a lot easier in understaffed delivery offices as they wouldn't have to find and pay someone else to do your duty while you are taking annual leave that you do not want to take.
Due to being off sick for the last few months, and having a few holidays booked during that period, I am in the situation where having returned to work this week I have to take nearly 4 weeks leave before the end of March and I'm told there are very few leave slots available.
In this instance paying you for unused leave would make sense, but I'm not saying it should be used for people who just blatantly don't take leave in order to get paid for it.

Sorry mate but it is illegal for RM to pay you for leave not taken. In exceptional circumstances ( Being off sick ) you can request to carry over more than the 5 days that are normally allowed. This must be agreed in writing by both parties.

Could an exceptional circumstance be that the lino REFUSED you the dates you wanted and then sequently REFUSED the other alternative dates you gave him.?

In that case you should put a grievance in against your manager. You should also ask what dates are available between now and the end of March as you want your contractual annual leave and that it is illegal to withold it from you. If you are flexible :Very Happy then you could agree to carry over any amount of holidays your lino cannot offer you before the end of March. But please make sure you get any holidays carried over in writing as linos come and go .

Thanks for enlightening me about the reasons why you cannot simply be paid for holidays owing to you. Still not sure why it is illegal though  but I guess rules is rules but it does not seem to bother RM for breaking them in every other respect.
