A Royal Mail manager from Northamptonshire has been paid his full salary for the past 16 months despite staying at home because bosses did not have a role for him.
An employment tribunal in Birmingham heard Peter Folwell (right) of Browns Close, Moulton, was a night shift manager at the Crick distribution depot and had been employed by Royal Mail for 27 years.

ter being involved in a row over contractual decisions but later appealed successfully.

However, Mr Folwell complained that Royal Mail management refused to give him a role, with the result that he was still being paid even though he did not go to work.

The details emerged at Thursday's hearing when the Royal Mail successfully applied to strike out a compensation claim for unfair dismissal.

Mr Folwell, who the tribunal heard had an unblemished record, said: "I have not worked for the past 16 months and I am virtually being paid my full salary to stay at home."

Tribunal chairman Frances Monk approved the strike out application after declaring Mr Folwell had been reinstated and was still being paid.

Gary Lee, representing Mr Folwell, said his client complained he had been left in limbo.

Afterwards, he said Mr Folwell now had to decide whether to resign and make a compensation claim for constructive unfair dismissal, because the firm's attitude would cause him to leave.

He said: "The fact is the allegations made against Mr Folwell which led to his dismissal were never substantiated.

"The Royal Mail reinstated him on his appeal simply because they knew they would lose a tribunal claim for unfair dismissal.

"To leave him without an official job is their way of trying to get rid of him. If he resigns and makes a claim for constructive unfair dismissal that would be playing into the Royal Mail bosses' hands.

"His grievance over the way he has been treated is still under consideration by the Royal Mail."

Gardening leave is no longer an option for surplus staff. You will be expected to report for work each day and sit staring at the wall. You will be told to attend an outplacement company (to assist you in being managed out of the business), you will be told that xmas pressure is mandatory for you for the full period (6 weeks) - (not vouluntary) and you may also be told to volunteer (!?) for charity work. You are not eligible for any pay rise and you will be told that there is no role for you within the business as the business believes you are of no value. What you won't get is 'respect and dignity at work - despite the DRAW inititative. 'reasonable' VR terms or another job in Royal Mail. What you will get is largely complete indifference and much shrugging of shoulders from HR, the CMA and everybody else involved - they just want you to leave.

An unbelievable story. Once again RM comes out looking like s**t (again!) So they sack him...he wins his appeal and to retaliate, Royal Mail find no role for him?

I've heard of situations where SM's are threatened with the sack , it can be anything ; a vicious system - nobody is immune - - you get this sort of thing with a push towards privatization and/or trying to go all corporate , the irony is you end up with the worst of both cultures .

Problem is middle management and the perverse interpretation put on matters by Senior Managers , I agree that RM just hoped he'd go , secondly it seems they hoped he'd bottle out of a tribunal , a tad arrogant .

Very contradictory , begging more questions than answers , and odd but hardly a surprise these days , that's managing by dicktat for you , no joined up thinking with all this blue sky stuff . RM seem to be in a permanent panic mode lurching from one self inflicted disaster to another .

If it was some jumped up ambitious but mediocre non - op's clerk that would have sold his ar** in Woolworth's window for £10 and shopped his mates for the price of a pint - I'd have no sympathy - but this sounds like someone's face simply didn't fit .
