Then brother Tall Guy for an informed debate why in the past have the CWU had to make strong representations regarding the then ongoing saga of blatantly obvious accidents being declassified by the AMU (Accident Management Unit) as "Not an Accident on Duty" sending out around 9000 such letters in the six year period 2000 to 2005. Accepting that some of those decisions may be correct (not my words) many were not. A number of cases raised by the CWU Health, Safety & Environment Department called for only trained people to deal with such accident decisions and for a new system whereby Safety Reps would have an opportunity to input into any decision making process which decides where a reported accident was in fact an Accident or not.

I do not know if you are making particular reference to my previous posting or to most of the postings that have preceded your own.

There was a thread on here in late 2007, which I can't find now, where I had some pointers from good people on here regarding an AOD that I had. I'm sure in the guidelines that RM give to managers, they can only use / count an AOD towards a Stage warning if they have reason to believe that you contributed in some way to your accident, e.g. by not wearing the correct PPE (Personal Protective Equipment, such as RM shoes), or being in an area you should not have been etc etc.
If they believe that you contributed in some way to your accident, however, they must write to you within (I think) 7 days to advise you of this. Should they fail to do so within that timescale, it is deemed by default a pukka AOD and cannot be used towards your dismissal. Get your rep to check this out.

I went in to my Stage interview armed to the teeth with arguments, but in the end the manager did not issue the Stage as 'one of the absences was as a result of an AOD, which is not disputed'

I had the correct footware, uniform, hi-viz etc also I have a witness, one of my customers came running out to see if I was ok, I'm going to go back Monday even though my leg still does'nt seem quite right. I've not heard from them all week and I'm getting paranoid that they are planning my dismissal.
