Re: trespassing?
It not trespassing because we're invited onto every property in the country. I believe it's called 'Implied Consent' otherwise how does anyone expect to receive their mail.

Re: trespassing?
as long as you just stay on the garden path up to the point of delivery, the letter box, and then exit the property the same way, you are not trespassing. if you deviate and go into a back or side garden, then it may be classed as trespass.

Re: trespassing?
does this include trudging on to the property front garden to go across to the neighbours front door instead of walking back and using the footpath that way?disgruntledpostie1 wrote:It not trespassing because we're invited onto every property in the country. Re: trespassing?
You shouldn't be doing that anyway because you'll not be covered by insurance, you duty should be timed to include walking up every path/driveway to the delivery point and not cutting across peoples gardens to try to save a few minutes.mosaddler wrote:does this include trudging on to the property front garden to go across to the neighbours front door instead of walking back and using the footpath that way?disgruntledpostie1 wrote:It not trespassing because we're invited onto every property in the country. I believe he was using a pencil to push the mail through the letter box, although he sued the owners, HE was found guilty of trespass, and fined 600 pounds, as the Judge deemed he , by putting his finger through the letter box was guilty of tresspass!!!!

Re: trespassing?
We are only insured as far as the outer surface of the front door. putting our fingers into the letterbox, let alone through to the inner surface of the door, is effectively, tresspassing.
Just spilt stain-remover down my shirt. Now how do I get that out?

Re: trespassing?
And THAT is very good advice - I buggered my knee stepping over a small wall between two houses - caught my boot on the coping stone but was moving forward, managed to get my left leg over, (no smutty asides please) but my right leg was too close to the wall and bent my knee the opposite way it was intended. Cut a long story short 5 years later I had to give up delivering because the knee joint was gone. So go the long route, it's safer.disgruntledpostie1 wrote:You shouldn't be doing that anyway because you'll not be covered by insurance, you duty should be timed to include walking up every path/driveway to the delivery point and not cutting across peoples gardens to try to save a few minutes.mosaddler wrote:does this include trudging on to the property front garden to go across to the neighbours front door instead of walking back and using the footpath that way?disgruntledpostie1 wrote:It not trespassing because we're invited onto every property in the country. Re: trespassing?
There is only an implied license under Common Law for people to be able to visit anyones property without express permission; the postman and people asking for directions for example (Armstrong v. Sheppard and Short Ltd [1959]
The Scottish position on trespass requires a period of permanency or damage.
So in either case we are covered as long as no damage occurs and you don't put a tent up in their garden
. Damage AFAIK does include damage to grass or walls/hedges - so only use the paths is my advice.

It has been a source of amusement though I could do with getting a leg over before the grim reaper makes an appearance. The wife queued for four hours outside the cinema when "Free Willy" was on - you have no idea how disappointed she was.
