As I said on a previous thread re: sick leave, a DOM knows more about health than any qualified GP or consultant or ATOS - in it's own head. One only has to ask what medical qualifications a DOM has compared to a GP to arrive at such decisions.The matter usually rests there. The correct ranking is:

1) GP
2) ATOS

:nana Do not go back to work while still on the sick, If you do, and have a set back, and then return to work, it will be
considered as two absences, and you'll get a warning.

As I understand it, though I do not agree with it the pecking order is.

ATOS - because they are recognised as Occupational Medical experts ( :left: ) but they must take in account the GPs views as they know your medical history. However, they don't have to act on it and have to give reasons why not.

GP - for obvious reasons.

DOM Manager - Bottom as they have no understanding of occupational medicine and must not act without advice from ATOS.


I my GP ever said I was not fit enough to work but ATOS said I was I would make sure any rehab plan included my GPs comments on why I was not yet fit to return to work, and that I was doing it under duress. I would also if the GP was willing ask him to check over the plan and make comments as they saw fit. I would also then include this in the paperwork.

At the rehab meeting I would have Union representation and I would type my own statement to be included in the paperwork.

Get those I's dotted and T's crossed it my advice when dealing with RM/ATOS.
