We first had this from one of big :lfo 's "love children " - not informing adequately constituted " unauthorized absence " and CofC - Quell surprise ! - RM sound if they've moved the goalposts there and/or are being possibly overzealous .linkinpark wrote:They phone you up? Where RM could be out of order ? is that everything on Planet RM is very black & white & judgemental as we all know . In a Tribunal , it would have to be asked whether RM acted reasonably ? - the grey bit !
I'd check out whether this is legal under RMAP , with some of the RDC's well before the last dispute , RM wanted a new RMAP which included ringing in before duty even when sick every day and removal of DDA protection .
RM backed down after a successful CWU ballot for IA even in places like NDC where RM purposefully recruited from outside the Industry to dilute the CWU influence . The CWU had to fight RM tooth and nail over this for a long time - sounds like it stayed on the backburner and there's pressure from on very high to get this through ?
We've had repudiation of contract sacking threats in another Industry - only when the Union Area Organizer was brought in - did Management back off - it would be easier to get rid of staff that have been with RM less than a year this way .
Something to do with " You're not interested in informing us so therefore we are not interested in employing you or you are not in a position to fulfill your contract so we are "letting you go " " - if you were say on trial , and managers thought you were taking the p*** - they'd sack you anyway - apparently there was a watershed tribunal case which is used as a reference point .
RM's Area management would accuse people of not taking their jobs seriously enough - there was a case in "The Sun " when they sacked someone for getting injured playing amateur football - though his normal attendance wasn't that bad beforehand
Where RM can come unstuck is when they start making assumptive , black & white statements / judgements
I stand corrected if I'm wrong and/or out of date on things

return to work discussions shud they also be done in the 1st 48hours back i have had one the next week at time then they ask are u fit to work jokers at times.
still not sure if they shud ring every other day or shud we ring them ?

whilst our procedures for sickness are very grey in parts we actually (established staff )dont to badly when it comes to sickness compared to other places.out of all the issues within royal mail this is one which royal mail would change to the detriment of staff.whether this is one of the spanish practices ,crozier stated is unknown.the cwu through the years have got us generous terms and we should fight tooth and nail to defend them.
