There's the rub - the waiting for the van - which the Manager will see as unproductive time and the current thinking is working the hours you are paid for and "waiting" isn't working.
Nor is drinking coffee but the Managers manage :)

I do see your point but as I stated, it depends on what round I am on that day. I do not see why I should alter my start time by 1hr+ to suit a Manager at a moments notice. This was a flexibility question and if it was a maximum change of 30mins or more :)

Also the others on that round (30+ hours) do not get the same treatment. Discrimination?

Thanks for all your input :-)
Glad to see you have a sense of proportion IPS, I wasn't intending to be critical but it would be difficult for the unit rep to justify the waiting time BUT if others are being treated differently then there is a case to justify - start and finish times seem to be pretty arbitrary at this point and there is the question of the terms of the contract which would, in your case, be 25 hours and the start and finish time be largely dictated by what the current work plan is which in turn should be agreed by the unit rep. I should start at 9.00 each day with a round thrown in but the delivery I am on at the moment means I do not leave the office until around 11am as thats when the van leaves for the other lads at that delivery point. Obviously with meal relief and getting back to the office time this only leaves me around 2hrs to do a 4hr ish delivery. Everyone else at that neck of the woods in on a much bigger contract (min 30 hours) which I do not feel is very fair.

Can the Lino force me to start over an hour later? (10am), I thought flexibility was a maximum of 30mins from usual start times but I would like to have this confirmed by someone in the know

Every single day, regardless of workload, I seem doomed to go over my allotted time.
Please forgive me if I appear a bit numb but if you have a 5 hour day and you only get 2 hours delivery time what are you doing for the other 3 hours?
The van does not leave until around 11am.

And I make it one hour 'lost' if you take into consideration meal relief, biking back and bag drops.
You start at 9, the van leaves at 11, what do you do between those times?
Throw in remainder of walk, redirections, band up, bag up and then wait for the van.
:no no If your on a 25 hour contract you should not have to throw any of your walk in, so tell your lino to do one. :so there

as a p/t employee covering a f/t post you are only covering part and not all and as such the management will argue , and i believe sucessfully, which part of the duty needs covering.
obviously the dely 3.5 hours
acceleration to and from 30 mins
mr 30 mins
indoor work 1.5 hours ? the volume of avaliable indoor work for you is questionable given efficiencies indoor absortion lapsing and the like

your original questions were what rights do i have and can they do it .
Given my first line possibly the answers are not what you were hoping to hear.
Confused... You won't be, after the next episode of. SOAP

Meal relief for a 5 hour duty is only 20 mins not 30 mins. You have to be over 5 hours to have a 30 minute break.

This is all to do with the flexibility of Phase 3 Agreement. To be honest it's the way things are going to be and will not get better, wait until Phase 4 comes in !

Is this true?

Today I was still throwing my walk in at 10.15am. Then after redirections, bagging up and knocking off it was after 11 by the time i got to the first door on my round.

Finished at 3.30pm. just got in. Im on a 25hr contract so I put the overtime in. But its still a bit too regular for my liking

As far as I understand it and I may be wrong. The 25 hr delivery contracts were initially envisaged to be pre-prepped, but with this new flexibility agreement you can be asked to do any work that you have been trained to do so this is where management catch you out.

However, overtime in not mandatory, in fact to make it so is illegal; So this does give you an option. If you are getting fed up of doing the overtime you can always inform that manager at the start of your duty that today you will be unable to work beyond your contracted hours because ................ . (You don't need a reason as OT is not mandatory). They then have to take this into account and come up with a solution, other than you working over.

You will experience pressure by them asking if you could work over, but if you stick to your guns it will mean that they can no longer expect you to "just get on with" which is what happened to me till I refused OT in my first 6 months.

I am quite certain you are right about the overtime but do you not think that in many instances the 25 contract people are always under pressure to do overtime in case there is a possibility for a full time contract in the future.

Definitely - I felt that pressure when I was on a 30 hour contract. I suppose the decision is how much carrot dangling can you take before you realise they may be taking you for a mug. If you want the OT then grab it with both hands I say, but whichever way you want to go make sure its an informed decision and its your own decision no-one elses.

There must be an element of fear in some because you are always going to get the "I'll do it" brigade who are going to be looked on more favourably than the guy who will only work his contracted hours and work overtime only when he wants and not when the manager wants. TBH I think RM forget that we do have a life outside RM and if there is a shortfall in any duty indoor or out then that problem needs to be addressed on a permanent basis and not by short changing good workers. I'm surprised that the union allowed so many part time employees and of course RM have exploited that fact to the full extent.

I have always been under the impression that meal relief for 25hr contracts is 30mins and have always taken 30mins..I got told that anything over 4hr 59mins is 30 mins anything under is 20mins...can anyone confirm this please

You are correct: 3 hours 31 minutes to 4 hours 59 minutes is 20 minutes break.
5 hours to 7 hours is 30 minutes break.

Way Forward. Section 5. Meal Breaks for non-standard, part-time and extended attendances.

Thanks baldrick thats what I had been told and have argued this with managers in the past when they have tried to tell me that I am only entitled to 20 mins not 30mins but they always seem to back down in the end :Very Happy
