In our Delivery Office we have Matrix Duty Holders that cover the rest days of the duty holder. For example duty 1 has monday off and the matrix duty holder covers duty 1 for monday, duty 5 has tuesday off and the matrix duty holder covers duty 5 for tuesday and so on and so forth. The only time that a duty holder can perform there duty on there rest day would be when either the matrix duty holder is on annual leave or sick and then and only then if that duty holder has a less overtime agreegate then a fellow college.

Whats going on here has nothing to do with the Pay and Mod deal mate, its colleagues just taking the piss and weak management letting them get away with it imhobogstandard wrote:In our area every delivery, on the intro of TWF 5 day week, was given the option/chance to perform thier day off as an S/A, and were given first refusal for the s/a as it was identical to their mon-sat duty. Those that took their day off forfited the s/a and also lost earning potential for the office as their day off needed to be covered so a cover duty was created. If the cover duty was created specifically to cover these duties days off then the holders have given away the right to claim it as theirs under the way we operate.
All depends really, stand your ground don't budge from this point of view, unfortunately under one of billy and dave's all encompassing two year agreements, which, is by and large regarded as sh*t, although is more commonly know as the Pay and Modernisation agreement, you must do what you're told even if you know its wrong and fill out an individual grievance proceedure form. This will get you abso-f*ck*ng-lutely nowhere.
As an individual initially there appears to be no hope, what you need to do is get everyone who is affected together, demand an EGM of your office with the motion to stop this action and if need be arrange the time and date of the meeting. If you have to have it without the rep then so be it, you can also under AOB discuss your reps actions, if possible identify a deputy rep, put them forward for the postion and go to them at all times bypassing the current rep.

True, although the original post was, what right do floaters have, and a scenario put to us. i have put an alternative scenario that inculded the P and M agreement.johnnyp wrote:Whats going on here has nothing to do with the Pay and Mod deal mate, its colleagues just taking the piss and weak management letting them get away with it imhobogstandard wrote:In our area every delivery, on the intro of TWF 5 day week, was given the option/chance to perform thier day off as an S/A, and were given first refusal for the s/a as it was identical to their mon-sat duty. what we need to know is.
was a duty created to cover these days off, if so has it been signed for.
if it has then the duty holder has the right to be treated exaclty the same as other duty holders and not mucked about.
Alternatively if this person is a reserve they go where they're sent and do what they're told, and if they dont like i feel that relevant part of my first post is applicable.

yes this duty was created to cover these days off, and the lad in question chose the duty during our last repick several months ago.
there are a few duties like this in our office, and thanks to this topic they are all going to get their heads together and discuss their next move.
thanks for all the info and advice so far, please keep it coming as u are all a lot more helpful than our office rep.

All you have to do is get the floater to tell the guys in his group that if they work their day off
then It has to be the duty that is on OT. If they dont do this then the floater explains that he will work his day off
but will choose their duty and he will have to do the OT round. If the DOM allows one of the group to choose their duty rather than the OT duty then he must allow the floater that option too, otherwise he leaves himself open to a grievance.
The only time the DOM can allow someone from the group to do their duty rather than the OT duty would be if the postie didnt know the OT duty and the floater did.
Sorry if it is a bit confusing

At my DO we are never offered OT unless the cover guy is away. If the managers asks me an I know that the Floater will be in, I tell the manager I don't know till I talk to the floater. I then go and ask him and if he wants to stay on the duty then I won't come in on my duty.

Thats how it should work
wanted the OT but didnt want to move to a different duty.
They know now that I will work my day off and do their duty
if they dont ask me first

I'm also the floater/5 day cover duty holder, in my office the guys that are asked to work their days off make sure i get something decent or it's a no show from them, the other floaters aren't so lucky though poor sods are thrown to the wolves, we put our foot down and had a meeting the rep just smiled and pointed to the dom and said it's up to him, your 318s all say as directed by line manager,

I dont know if its me but this descripition of a Floater on the site is different to what i would call a floater. This is a Rest Day Cover who covers guys on walks when its there days off.A floater at our place is a reserve(guys who cover A/L and S/L)who has no duty for the day or days as the leave spread is not full and no one is off sick so they are floating with no duty to cover and are directed by management as what to do.

If i understand this correctly people are being offered the chance to work their day off on the walk they perform 5 days out of 6 mon-sat at either O/T or S/A rate and in doing so are displacing duty holders who cover that walk on the day in question. If this is the case then i do believe there is an argument there because as i understand it you cannot be removed from your duty and someone else paid O/T to do it.
The 318 outlines a series of tasks that you are required to perfrom during your working day,
you can be removed and asked to perform another element of work if a task no longer exists
somebody getting paid O/T or S/A cannot displace someone being paid basic wage.
Does the cover duty holder get removed if there isn't another walk to perfrom?
Someone wishing to perfrom O/T is a volunteer, and as such should be perfroming what is avaliable not what they want to do.

unfortunatly a reserve is a reserve (floater sounds a bit shi**y)

Quick update.
Couple of the lads this is affecting got their heads together and contacted our area rep(bypassing our chocolate fireguard office rep).
He phoned this morning but its our DUMS day off. He will be on the phone to the DUM first thing tomorrow to put a stop to this happening.
When our office rep found out his response was, "Well you will end up absorbing walks more often now cos duty holders wont work their days off".
Wouldnt you think he would be pleased that these lads are going to be treat fairly in future.
The fact he has worked his day off for the last 7 weeks(on his own duty) had no bearing on this statement I presume.

To be honest he is totally un-interested in getting people to do the job properly.
The amount of people(him included) who come in early, use cars, miss breaks etc etc in our office is unreal.
But when he gets told we have to lapse he accepts it without a fight, and his lambs follow in his footsteps. Then they rush round like lunatics to get it done, and even go to do their part of the lapsed walk in their cars.
There is a small rebel core who are fighting for whats right.
I feel like Luke Skywalker.
