Royal Mail workers fought bosses over extra prayer time

Two Royal Mail workers launched a legal fight against their bosses for more prayer time, it has emerged.

Abdinour Omer and Guled Bashir, both devout Muslims from Bristol, took the action after having a request for more breaks turned down.

Managers at Royal Mail's South West Distribution Centre in Severn Beach, Bristol, told the men that they were entitled to no more rest periods than non-Muslim colleagues.

The two men took the company to an employment tribunal, claiming they had been victims of religious discrimination. However, they dropped the action shortly after the hearing began after their legal representative was told they had "no chance of winning".

In a similar case earlier this year, the tribunal chairman, Clive Toomer, found in favour of Royal Mail. He dismissed claims of religious discrimination from Abukar Jimale.

A translator for the two men said: "The judge had heard a very similar case a few weeks ago and he found in favour of Royal Mail, so he was certainly going to do the same in this one."

Mr Toomer said Mr Omer's and Mr Bashir's case should have been combined with Mr Jimale's.

He told the tribunal in Bristol: "The claimants wish to withdraw their claims in the proceedings and the respondents have agreed."

He added that in return for dropping the action, the pair would not have to pay any legal costs to the company.

A Royal Mail spokesman said the decision was a "victory for common sense".

"The two men were agency staff who were hired by Royal Mail to work in the distribution centre," he addded.

"They worked the night shift between 4pm and midnight and, as any employers would do, we gave them breaks in that time during which they could have prayed."

Mr Omer and Mr Bashir no longer work for the company.

Why the hell would any employee who is supposedly vetted need a translator, did they actually do any work since their command of the English language is rather questionable?

they tend to be put on sorting in mail centres - any problems - it's command and ignore - one lady won £17,500 in a ET - there was complaints about missorts - however RM only tested the men - there's a quite a few people playing a version of Snap with addresses and matching them to the frames - you'd be surprised how many people who can't read

It wouldn't do to say too much about it as the RM Puritans or Spanish Inquisition will put you on a H&B charge

on delivery there was a postman asking " where is the other B******l Road - he didn't understand the even and odd side numbers concept

on topic, it seems to me , that these ethnic particularly Muslims are expecting us to accomodate them at every turn at the expense of the Majority, when we go to Saudi Arabia, Dubai, we cannot carry a Holy Bible, or drink alcohol openly or christian evangalisim is banned, we are expected to follow the rules of other countries while ethnics here gets special treatment, its wrong and stokes resentment, when any comes to this Country especially when taking an oath of Allegience on taking British citizenship must know that this Country is mostly Christian, liberal with views that may not be compatable with their home culture, they have to adapt to that or leave.

The recent court cases by Asian police officer and hiring a dodgy Asian lawyer is making other decent hard working Asian police officers look like a bunch of ungrateful moaners and getting a bad reputation by association, these officers that are taking the Police authority to court are senior officers and I fail to see where the discrimination come into this, if an Asian PC took his sergeant exam and didn't get promoted after 5 years fair enough same as anyone else without regards to ethnicity, blatant unfairness is indefensable, but the above Police litigants sounds like they are trying it on.

Why couldn't they have the times of their breaks changed, to enable them to Pray at the appropriate times?

They can't expect to get any more breaks than the rest of us. But on the other hand. It's immoral to prevent someone practicing their Faith. I don't actually know, how often, or indeed when. They need to Pray. But Surely, if their breaks were re-arranged, or even split into more short ones (adding up to the same time, as the rest of us). They could be accomodated.

Just because other Countries are intolorant. It doesn't mean that we should descend to their level!

hang on a second ! - who told them or put ideas in their heads that they could take RM to Tribunal , who filled in and sent the IT-1 form , why did it get past preliminary hearing stage ? that's to sort out the chancers being a pain in the arse - why didn't ACAS stop it and try to mediate ?

RM - common sense RM must be responsible for a large part of the ET waiting list with their "moral" crusades , dodgy RMAP and CofC charges that should never got as far as a Tribunal .

I can remember people clapping and cheering and waving newspapers after 9/11 , of course no action was taken , all RM are interested in is impressing those idiots in charge who in turn are only interested in impressing naive , gullible middle class people with no common sense , perspective who are only interested in keeping their cushy numbers at public expense in air conditioned offices .

RM with their area and senior managers and certain employees have the best recruiting sargeants that that slimey glass eyed Nick Griffin and his vile BNP party could ever wish for

I hope and expect that the recession may mean that RM can employee people from a broader spectrum of the employee market. By this I mean that some unemployed people will now be prepared to do these RM jobs that no-one else wanted to do, which meant that RM had to employee people who were clearly not upto the job. I remember this happenign when I was in Ops and was sending back the majority of agency staff.

I agree that it's unwise to choose to go to a Country, which is unlikley to tolorate your Customs and Religion. But there isn't always a lot of options available. Because the cost of living, is so high in Britain. The wages are high, compared to a lot of other Countries. That's why, for example. If you go to America, everything seems so cheap. Believe me: It 'aint cheap for the Yanks! Their wages are proportionate to the cost of living.

Therefore. If someone is struggling to support their Family. The obvious choice, is to come here. Keep enough of your Wages, to survive. And send the rest Home. That little bit of left over money (by British standards), is often enough to support the rest of the Family, on it's own. Particularly, if they live in a poor Country.

Would you do any different, if it was the only way to ensure the survival of your Family?
Or would you let them suffer, to avoid you having to put up with predudice?
I'd do exactly what they are doing. But I would do whatever I could, to keep my Culture alive, until I could return Home.

If I was invited around your home as a guest I would not complain that your hospitality is not as good as mine or complain that your religion is not as good as mine or insist that you allow me to do what I want in your home cos that’s what I can do in my home. Why should I insist you change everything you like just for me?

If it is so bad in this country for SOME visitors invited here as our guests, why stay at all? If your theory is correct why is it so hard to live in the USA or Australia even with skills?
Most foreigners invited here get on with it and do a day’s work and don’t perpetually whinge about how unfair we all are and credit to them.

I am struggling and if I decide to live elsewhere I will do in Rome as the Romans do cos all the whinging in other countries will get me no change at all unlike this dustbin called UK

And what exactly did they say, that lead you to believe that they thought that the British, were inhospitable?

All they did complain about, was their EMPLOYER'S refusal to accomodate them. There are plenty of other people in RM, who are allowed sufficient Prayer time. So why should they be any different?

You see, the whole point is: If some people are accomodated, then why shouldn't everyone?
Now whether their requests were in line with what others have asked for. Or whether they were trying to take advantage. I don't know. If it's the former: Then I feel sorry for them. If it's the latter: Then they deserved to loose. But as we haven't been given enough information to know which. I'm giving them the benefit of the doubt. Don't you think you should too?
