Inquiry reveals unchecked use of private vehicles.

The security of the Royal Mail is being put at risk by widespread use by postal workers of unauthorised private cars to carry mail on their rounds, the Guardian has learned. Growing numbers of postmen are using their own vehicles to transport postal sacks, placing the bags at risk from thefts and break-ins.
According to the Communication Workers Union, managers at several depots encourage the practice or turn a blind eye in an attempt to meet delivery targets. Even in cases where private car use is authorised, the union says managers often fail to carry out document and risk assessment checks to ensure vehicles are roadworthy and secure.

Good find BM.

This really grates me......
a "zero tolerance" approach to anyone failing to comply with rules. But it is now reviewing whether the rules are being "followed consistently, every day, in every delivery office. The security of mail and the health and safety of our employees and the public are of paramount importance to us", said a spokesman.

Introduction:
This document pulls together and (where applicable) updates all existing policy and guidance documentation covering the scheme for use of employees' private cars on delivery work in order to protect the individual, Royal Mail and managers in their day-to-day work. Advice on the insurance claims process, document checks, control documents, health and safety and private cars and the conduct code is provided in current documentation which is availble via the Delivery Intranet site. This policy is mandatory.

The use of the Royal Mail business insurance cover is only effective if an employee has completed the declaration form and sent the appropriate letter to their insurers, had their appropriate documents checked, had the vehicle checked for road worthiness and is therefore authorised to use the vehicle by the Delivery Office Manager.

If an employee chooses not to use their own vehicle, it is the manager's responsibility to provide official transport.

It is vitally important that periodic checks are made to establish which employees are using official transport. This is to ensure employees are not using their own transport unofficially.

Royal Mail needs to know how employees get to and from their delivery rounds, and may need to demonstrate this to comply with Health & Safety law.

Employees using their own transport on delivery during the following:

any part of a working day
any part of a week, including Saturday
any part of a year, including Christmas

must be covered by the revised process.


The following pages provide the policy and guidance on key points.

Royal Mail Policy Private Cars on Delivery:
This Policy operates in line with the conditions of use set out below and failure to comply in full with all of them is a dsiciplinary offence.

Delivery employees may use their private cars for travel to, from and during a designated and authorised delivery route, for their own convenience, by agreement with their Delivery Office Manager and subject to certain conditions being met.

Private cars are not official transport. Therefore the use of private cars must not be assumed in the construction of delivery duties and will not be. There is no payment to employees for use of private cars. Revisions must not be planned on the basis of the use of private cars.

The choice to use a private vehicle on delivery is the individual’s. However, once an employee chooses to use his/her vehicle on delivery it is his/her responsibility to ensure that he/she obtains permission and complies with all of Royal Mail’s conditions for use of a private vehicle on delivery in accordance with the Policy.

Use of private cars must be with management authorisation and with sufficient, adequate and appropriate insurance. Prior permission for use of a private vehicle on delivery must be obtained. The individual must own the vehicle and possess a valid driving licence and MOT certificate (if required by law for the vehicle being used) and ensure the vehicle is roadworthy.

Processes will be provided to ensure that both the individual and his / her manager comply with the terms of the Policy and that compliance is periodically checked by the manager.

This Policy is discretionary and may be withdrawn by Royal Mail at any time without notice and for any reason without explanation.


Royal Mail Private Cars on Delivery Conditions of Use:
Applications for Permission
In order to apply for permission to use their private car on delivery an employee must produce the following:

Their vehicle registration document
Their current valid driving licence.
Their current valid certificate of insurance covering the vehicle.
Documentary proof of ownership of the vehicle
A completed letter notifying their own insurers that they intend to use Royal Mail’s business policy whilst driving on delivery
A completed signed declaration of intent relating to the vehicle to be used on delivery
A current valid MOT certficate for the vehicle to be used on delivery where the vehicle to be used requires one by law
The vehicle for a visual inspection

Employee Obligations once Permission has been Granted:
Once permisison has been granted it is the employee’s obligation to ensure that:

He/she only uses the vehicle when in possession of a valid driving licence.
He/she has a valid certificate of insurance to meet their liability to third party insurance claims.
He/she ensures (and can produce evidence if required) that his/her insurer has been notified that the vehicle is being used for business use and is covered by Royal Mail’s Business Policy. It is the employees responsibility to ensure this is acceptable to their insurers.
He/she must own the vehicle for which permission is granted.
He/she has a current MOT test certificate for the vehicle, if required by law.
The vehicle is maintained in a roadworthy condition and is available for inspection.
He/she produces all the above documents for inspection every six months or on demand.
Where any of the above documentation expires between inspections he/she produces new documenation for inspection by his / her line manager within a week of expiry.

All delivery and collection work is performed in accordance with specification (ie in respect of route, timings etc).
When the vehicle is used in connection with delivery work, the only passengers permitted to be carried are other delivery employees on authorised delivery duties who are being dropped off at a delivery route adjacent to the driver’s delivery route.
Normal security of mail applies (ie any “second pouch” mail left in a car whilst the employee is making the delivery, should be out of sight in the boot of the car, with the vehicle fully locked and alarmed – where an alarm is fitted). In areas identified as high risk no more thab one additional pouch should be left in the car.

Royal Mail Private Cars on Delivery Policy
Guidance Notes:
1. Extent of Cover:
Cover has now been extended to cover the employee should they have to move their vehicle from the first point along the delivery route.

2. Moving the vehicle along the route – insurance cover:
The precise definition of business use varies with each insurer. Some insurers class moving along the route as a higher class of business use (courier use). Employees should not rely on the fact that a colleague’s insurer allows this, as all insurers will differ. Where movement along the route is excluded employees will need to bear this in mind if choosing to move their vehicles along the route. If the individual opts to extend their insurance to include business use then it is essential they seek assurance from their insurers that they are able to move the vehicle along the delivery route.

3. Moving the vehicle along the route – making drops:
Whilst movement of the vehicle along the route is now covered, delivery should still be made on foot and not by using the car as a means for moving from one delivery point to the next.

4. Business Use:
In the event that the employee’s insurance does not cover business use, then the employee will be covered by the business policy, for third party only.


5. Third Party Cover:
The business policy is for Third Party only and all claims whilst using the business policy will be dealt with as such. This means that the cost of any damage to an employee’s car will not be covered by the policy whether caused by the employee or another road user. Royal Mail will only cover the cost of the repairs to the third party. Where the employees private policy is extended to include business use the private insurer should handle the claim for damages to the employee’s vehicle.


PRIVATE CARS ON DELIVERY FREQUENTLY ASKED QUESTIONS

Q1, In a single sentence, what does this policy mean to me?
A, Royal Mail accepts the liability that would otherwise fall on you, the postman/woman driver, for any accident, for which you are to blame, that occurs whilst using a private motor vehicle to, from or around your delivery route (or, as a lawyer would phrase it, Royal Mail, assumes responsibility for the business use of your private vehicle and any risks involved in that, either in relation to injury to a third party or damage to third party property).


Q2, Will I receive petrol expenses?
A, No, use of cars is for your convenience. If your delivery is entitled to public transport costs normally, but you opt to use private transport, then you will not receive this payment.


Q3, Why does Royal Mail offer insurance cover to those using their cars to get to or from their delivery?
A, It is a criminal offence to drive without insurance. Royal Mail is concerned that both it and its employees do not offend against the requirement to have insurance. You should be aware, that the cover provided by the Business is for Third Party only. This means that Royal Mail’s insurance will not meet the cost of any damage to your vehicle even if another road user causes an accident. If you cause, or are deemed to be the cause of the accident then your vehicle will not be covered for the cost of the repairs. Royal Mail will only cover the cost of repairs to the third party (even if your private policy is fully comprehensive). Where you have extended your private insurance policy to include business use your insurer should handle the claim for damage to your own vehicle.


Q4, Will I be subjected to the conduct code if mail is stolen from my car?
A, Not if you have signed the undertaking and taken all reasonable precautions, i.e. kept delivery bags out of sight in a locked boot.


Q5, What if my car is a hatchback and so has no boot?
A, As a general rule, you must make sure that you cover all mail/pouches, in the rear of the car, ensuring that they are fully out of sight and that the vehicle is locked and alarmed where possible. It is your obligation to ensure your mail is kept safe. Where a car has no boot then neither extra pouches nor mail should be stored. Employees should make use of existing pouch drops.


Q6, What happens if I refuse to sign the undertaking?
A, Then you will not be authorized to use your car and would be subject to the conduct code should you then do so.


Q7, Why is it necessary to inspect my car to ensure it is roadworthy?
A, Royal Mail requires all vehicles used for business purposes to be roadworthy and fully maintained in order to minimize any risk to the safety of employees and other road users.

Q8, Who will inspect my car to make sure that it, is roadworthy?
A, You will need to produce all relevant documents to your manager on a six monthly basis. This will include the current MOT certificate. However, this doesn’t prove that a vehicle is roadworthy, so your manager will carry out spot checks. This will include checking:

That all the tyres are legal (visual check only)
That the vehicle has a current road fund license displayed
That all the lights are in working order
That there are no loose/hanging parts which could constitute a safety hazard.
That all the doors and boot can be effectively secured
That all windows can be closed

Q9, Can you refuse my request to use my private car?
A, Yes, at Royal Mail's discretion. In determining whether to grant, refuse or withdraw permission Royal Mail will consider (amongst other things) the condition of the vehicle, the insurance risk, security and the need to provide a reliable service. For instance, if you have incurred a number of previous accidents or have a history of prosecutions, which are recorded in your license or insurance certification, or locks which are worn or slack, or if your manager has any doubts as to its roadworthiness, as detailed in Q8 permission may be withdrawn. The Delivery Office Manager has the authority to refuse use of a vehicle if he/she considers the risk excessive and/or if he/she considers it is in the interest of Royal Mail to do so. The Delivery Office Manager's decision is final. There is no appeal authority. Permission to use a private vehicle on delivery is within the sole discretion of Royal Mail.

Q10, How will claims for accident damage or loss be handled?
A, The process for handling claims is the same as for official vehicles. A copy of your insurance policy and any amendments to it will have to be provided to the Accident Management Centre to enable any claim to proceed. You should also note that Royal Mail reserves the right to liaise with your insurers if it has any concerns regarding a submitted claim. You should also notify your private motor insurers of any incidents.


Q11, Can I drive my car for Royal Mail business if I have a medical condition?
A, For medical conditions, the same rules apply as for the driving of official vehicles. If you are in any doubt, please explain the situation to your Delivery Office Manager and he/she will check this with Employee Health Services for you.


Q12, Will Royal Mail cover any loss of No Claims Bonus in the event of an accident?
A, No. This is between your own insurance company and yourself.


Q13, So does an accident have any effect on my private insurance?
A, Yes. An accident on duty may not affect an employee’s no claims bonus, but it will affect your record and therefore your insurance companies assessment of risk. Depending on that risk, it could increase subsequent policy premiums, just as an accident away from Royal Mail would. Royal Mail cannot provide any guarantee in respect of the way your insurer operates and you should clarify the position with them direct.


Q14, Should I notify my insurers of an accident I have whilst insured by Royal Mail?
A, Yes. Failure to do so could be used as grounds to invalidate your private policy by your insurance company.


Q15, What level of cover is provided for personal possessions in the car?
A, There is no cover provided under Royal Mails Third Party policy You should clarify with your insurer what cover is provided by them.


Q16, Will driving to/from my delivery affect my C&N overtime?
A, Potentially, yes. All the time spent driving for Royal Mail on business counts towards driver’s hours. However, for the vast majority of employees, the amount of driving is small and this is not foreseen as a problem, even when the overtime (and afternoon Scheduled Attendances) involves significant driving. This will be checked though, before any overtime is authorized.


Q17, Is it valid to have two insurance policies on the same vehicle?
A, Yes .In the event of an accident the most relevant policy will respond.


Q18, If I ask my insurance company to extend the cover on my policy to include Business use, are they entitled to ask for an increased premium?
A, Yes. It is a matter of discretion for the social use insurers, who are entirely within their rights to refuse a policy, or to increase premiums, when they are informed of the new totality of insurance on the vehicle. If they do impose a higher premium, it is up to the individual to decide whether it is worth it. Royal Mail does not reimburse individuals whose premium has risen, as a result of the new policy.


Q19, If I sign up to use my private car, does the insurance cover me whilst I am on the delivery or only from the office to the first delivery point?
A, Up until now, if you have chosen to use Royal Mail’s insurance cover, you have only been covered to drive direct from the office to and from your first delivery point. You have not been covered to move your vehicle along the delivery route. However the Royal Mail cover has now been extended in order to cover you should you have to move your vehicle from the first delivery point, along the delivery route. You must be aware however, that the cover provided by the Business is for Third Party only. This means that the cost of damage to your vehicle will not be met by the Royal Mail policy even if it is caused by another road user. If you cause, or are deemed to be the cause of the accident then the cost of damage to your vehicle will not be met by the Royal Mail policy. Royal Mail will only cover the cost of repairs to the third party (even if your private policy is fully comprehensive). Your own private policy will be ineffective, as you have chosen to use Royal Mail’s cover. Where you have extended your private insurance policy to include business use your insurer should handle the claim for damage to your own vehicle.

Q20, If I have business use cover on my own policy, do I need to sign the employee declaration?
A, Yes. This is required in order to ensure that there is written documentation held in the delivery office on all the private cars in use in that office and that all the necessary checks have been carried out in order to comply with the business policy.


Q21, The car I drive is not my own and I am a named driver on another person’s insurance. Will I be insured to drive on business use?
A, No. Royal Mail’s offer of insurance is only offered to employees that are the owners of their own asset, which is registered and insured in their own name. Any named drivers who are using other people’s cars should stop immediately and use official acceleration.

Q22, Could I be required or instructed to take second pouches for another delivery officer, if I go past the pouch box?
A, No. Neither of the insurance polices would cover this and you would therefore be driving your vehicle without insurance. It requires a higher class of business cover to be authorized to perform “drops” of goods. All pouches will be delivered to pouch boxes by official acceleration.

Q23, If I sign up to use my car, but decide on some occasions not to use it, will I be instructed to use it or have disciplinary action taken against me?
A, No. You have volunteered to use your car and not doing so incurs no sanction. However, if you are unreliable and give no notice of when you will or won’t, or say you will and then don’t, Royal Mail will prevent you from using your car and require you to use official acceleration instead by withdrawing its insurance from you.

Q24, Could I be asked or instructed to make collection from post / pillar boxes?
A, No. The policy specifically excludes this. You are not insured to make any collections with your vehicle either after finishing your delivery and clearing boxes on the delivery route, or to collect from boxes on your way back to the delivery office.


Q25, Could I be instructed to take another delivery employee to their first point of delivery?
A, No However, you can drop another employee and their mail off, should you wish to do so, as long as their delivery is adjacent to your own and you do not have to make any detours from the delivery office to your own first delivery point, in order to do so. Non Royal Mail employees are excluded from the insurance and should not be carried in the vehicle whilst under our business use insurance under any circumstance.


Q26, What if I refuse Q24 – Q25 above?
A, You will not be asked to, so the question is academic.

Q27, Once someone has signed up for the scheme, how much notice will they have to give should they wish stop using their own car, except for the normal reasons, loss of license – broken down etc?
A, There is no formal notice period, as such. We only ask that you give as much notice as you can and be reliable. In other words, treat your manager, as you would wish to be treated yourself. If you are unreliable, Royal Mail reserves the right to stop you using your private car, with immediate effect.

Q28, Does Royal Mail encourage employees to use their private cars?
A, No. We will not stop you as long as the journey is legally insured and that you have met all the other criteria. If you do not want to, that is fine by us. Official acceleration, either by bus, bike or crew bus, will be provided as appropriate and as planned for your delivery.


Q29, Can you summarise in one place everything the Royal Mail insurance policy covers?
A, Yes. The policy covers the following:
The cover is purely to allow commercial use on a 3rd party liability basis;
The cover allows delivery employees to move their vehicle around the delivery, not just to the first point of delivery;
3rd party cover means that if a delivery employee has a blameworthy accident, the claim of the other party is covered by Royal Mail, however damage to the employee’s own vehicle is not covered;
If a delivery employee is involved in a non-blameworthy accident, they should claim from the other party’s insurance, not Royal Mail;
If a car parked by a delivery employee is vandalized or broken into this is not covered by Royal Mail’s policy. Neither is any compensation nor the cost of any repairs resulting from such an incident payable by Royal Mail;
If delivery employees wish to have comprehensive insurance cover, they should arrange this with their own insurance company, having declared the intended use;
The insurance is only effective if an employee has completed the employee declaration form and had their documents checked periodically by the DOM. The vehicle must also be visually checked to confirm its roadworthiness. The documents to be checked are:
A current driving licence
A current certificate of motor insurance covering the vehicle concerned
A current MOT certificate (if required) for the vehicle
The registration document


Use Of private cars on delivery:

Employees declaration



I, , employed as a postman/woman on delivery work, agree voluntarily to use my private vehicle registration number on official duties strictly on the terms and conditions contained in the paragraphs below.


1, I will only use my private vehicle registration number ………….. to and from the delivery office to the first point of delivery and if the car needs to be moved along the delivery route, on deliveries specified by the Delivery Manager and in accordance with the instructions given by the Delivery Manager as to those deliveries.


2, Royal Mail management may withdraw its consent for deliveries to be undertaken by use of my private vehicle at any time, and if such consent is withdrawn by Royal Mail management then delivery duties must be performed by me in the manner laid down by Royal Mail.


3, I accept that I have no claim whatsoever to any amounts for the cost of using or maintaining such private vehicle (or any compensation in the event of damage to it).


4, I will produce six monthly and/or at any time on demand by Royal Mail management for inspection at my own expense:

The car registration document

A current driving license

A current certificate of insurance covering the vehicle concerned.

A current MOT certificate for the vehicle, if such a certificate is required under the Road Traffic Act


5, During periods when I am using my private vehicle for deliveries, the only passengers permitted to be carried in the vehicle are other delivery employees on official business.


6, All mail conveyed in my car will be out of sight. It will be secured by lock at all times and by alarm (if applicable) when the vehicle is unattended.


7, My private vehicle must be maintained in a roadworthy condition at all times. My private vehicle will be open to inspection by Royal Mail road transport staff at any time as and when required.


8, I undertake to notify Royal Mail immediately in the event that I become unfit to drive for any reason or if I am convicted of an Offence that bars me from driving which affects my vehicle insurance cover in any way. I confirm that my insurance cover authorizes me to use my car on delivery work on the basis set out therein. If for any reason my insurance cover is withdrawn I undertake to inform my line manager immediately.


9, I undertake to inform my insurers within 7 days of the use of my private motor vehicle on Royal Mail business in the model letter issued to me by Royal Mail. If my insurers should indicate to me any difficulty in this arrangement in their reply (whether or not arising from my existing insurance arrangements with my insurers) I undertake to inform Royal Mail management immediately of this fact on receipt of such a communication from my insurers.


10, I understand that the Royal Mail Group will assume responsibility for Third Party loss or damage, incurred as a result of the use of my private vehicle on Royal Mail business under the terms of this agreement. I understand that this does not result in any cover by or on behalf of Royal Mail (as part of the Royal Mail Group) when my private vehicle is used for private business when the cover will be my own insurance for the private vehicle.

This cover is for Third Party only.


I am writing to let you know that my vehicle is now being used on Royal Mail business, as you are the insurer of my own vehicle for domestic and pleasure use I enclose a letter from Royal Mail’s insurer, AIG Europe (UK) Limited, explaining the policy.

I find it strange that the document is on a CWU Branch website,who's sister site is a site that is/was trying to save a MC from closing down.
I realise it was put there in 04 before the current troubles,but give me strength,like i've said in the CWU ask for car banning article....

Royal Mail are more than generous in having you use your own vehicle at your own expense, paying for third party damage but not yours, encouraging you to pay extra for added insurance cover without any form of recompense and the union have done nothing about it for years.

I seriously doubt there is ever going to be an end to the use of private vehicles so it would make sense that the union should go at RM like a rabid dog to get some sort of financial package in terms of insurance, maintenance, tax and fuel. In order to comply with "green" issues there should be some sort of scheme for converting to LPG or some other greener alternative.

The CWU did make representations to Royal Mail on the issue of Private Cars being used on Delivery as can be seen from this short Guardian article (below) in March 2006.

After years of campaigning against the use of private cars on delivery, the Communication Workers Union took a pragmatic stance and tried to negotiate with Royal Mail (Postal deliveries by car increasing risk of thefts, March 11). Our objective was an agreement that contained risk assessments, safe systems of working, maintenance of vehicles carried out by trained Royal Mail mechanics, regular roadworthiness checks, the provision of comprehensive insurance and the appropriate remuneration for our members. The agreement would also have ensured that customers' mail was safeguarded at all times. Unfortunately, Royal Mail broke off negotiations to pursue its own strategy over the heads of the union. Its strategy ignores many of the safeguards that we attempted to negotiate and is primarily based on reducing costs. The answer is either to negotiate an agreement, or ban the use of private cars on delivery. Personally, I would prefer the latter.

Do however find it strange that it has not yet made an appearance as an LTB on the CWU website for the whole membership to read and take in. Why also has Keith Scott Royal Mail Group Head of Safety not been forwarded a copy as well. Ninian as I undersand it is the new RML Ops Director and has board level responsibility for safety.

It caused a bit of a stir with loadsa people actually taking notice of what it said ,the reps had a steady flow of car drivers asking
what they should do ,the reps told them the union stance now its up to your conscience .

The managers had a tough time taking guys out this morning :Boo hoo!

No, they shouldn't be providing conversions to LPG, or renumeration. They should be providing RM Vehicles. But they won't, because then everyone would find out, just how much pollution RM are responsible for. Green Policies my arse! They're just hiding as much pollution as possible, by making Posties use their own Cars. So they aren't included in the figures. :Sick :arrrghhh

Two of our lads have had accidents whilst driving private cars on delivery and BOTH managed to write their cars off. One sustained serious injuries to his wrist and chest, and spent some time off sick.

This was gonna happen sooner or later. The family will be pissed off when they learn the driver was using his own car on delivery. Its only a matter of time before someone gets there car stolen, burned out with the mail in their, etc.
