If that was a response to my post I guess you did not read it completely. As I have said throughout this thread, at the moment we do not know enough of the facts, and probably never will, to come to a sensible position on who was to blame. Without the full facts we do not know if Management, the individual or the processes/regulations are at fault, or even if it was a combination of all.

Also calling opposing members "brain-dead" by association because they have a different viewpoint is not really helpful to the discussion either. Please don't fall into the trap you sometimes say others have fallen into.

As an employee I have the right to work in a safe and healthy workplace this right is given to me by law and can't be changed or removed by management, who are after all the employer's representative in the workplace. To add further, management have a legal duty to ensure your health and safety while you're at work, providing you with a safe workplace, safe working practices, safe equipment, carry out risk assessments, first aid facilities, give you safety information about hazards, provide instructions, training and supervision where required and consult with the Union's Safety Representative.

The only thing that I require from mummy DOM is the right that is given to me by health and safety law, no more no less.

To whether it is a buisness or a service it is the management who have hold of the purse string's and who have the authority and responsibility to conduct employee's for non-compliance of health and safety!. SO THE BALL IS IN THEIR COURT!.

All true, although there is a further element that requires the employee to consider the safety of himself and others under the H&S 1974 Act, as I'm sure you appreciate.
Assuming he is a certified welder (by RM), the welding gear didn't malfunction in any way, he wasn't instructed to weld this item (and employees have the right to refuse to follow unsafe instructions) by his line manager, then it would appear that the welder must be "blameworthy" to some extent.
Enough H&S tribunals have ruled that after training employees can no longer use ignorance as an excuse for accidents like this, or attempt to hide behind H&S regs.

Spot on. I don't wait by the side of the road and ring the DVLA to advise me how to negotiate a roundabout safely each time or expect them to watch over me to make sure I do it right. As a pedestrian I don't assume that the DVLA, government or highways agency is to blame because I step out into the road without looking. The rules of the road are for the most part extremely clear. Commonsense has a big part to play. Everyone at work has a responsibility to uphold safety rules, no one is arguing with that but to suggest that management are responsible for every breach or must be watching everyone to make sure everything they do meets legal requirements is absurd. The responsibility on a day-to-day basis rests with those that increase the risk by not adhering to the rules. As it is in life.

Just like the DOM at Brentwood DO who following an investigation by the CWU Area Safety Representative hadn't undertaken documentary checks as required in Royal Mail's policy and checked drivers licences, insurance and MOT certificates. Who also neglected to carry our proper safety checks on members of staffs cars which were being used on delivery. None of the Brentwood DO staff (at the time of the accident) had been 'authorised' to use their cars and none had been instructed by the DOM to sign the Royal Mail private car user's declaration for authorisation and business use insurance cover. I think you'll find RM indemnifies employees itself, though I suppose if times get any harder for RM it'll use a third party insurer to save money.

Do any of the CWU brothers and sisters know of any further updates to this explosion and fire incident which occured last September at Royal Mail Vehicle Services Guildford Road Transport Workshop.
