While all cases against individuals are supposedly judged on their individual merits pertaining to that case, and on the face of it a disgusting action. Has anyone considered that the employee concerned could have been suffering from an overactive bladder.

Many common bladder problems are caused by an overactive bladder just as many people are unaware of bladder problems and the difficulties they can cause.

* A sudden urge to go to the loo (called urgency)
* Some people may not get there in time so they have an accident(called urge incontinence)
* Needing to go very often - more than 8 times a day (called frequency)
* Getting up during the night (called nocturia)
* Wetting the bed (called nocturnal enuresis)

These problems are caused when the bladder muscle squeezes - even when you want to hold on. This is sometimes called an overactive, irritable or unstable bladder. The cause of an overactive bladder is often not known. It can sometimes be caused by an infection in the bladder. People who have had diabetes or a stroke may also be affected. An overactive bladder can cause even more problems for people who cannot get to a toilet quickly.

Hello Brothermagrew,would you have been so understanding if you or your good lady had looked out of your back window and seen said person p+ssing up your wall? would your first thought have been oh that poor man must have a bladder problem,or would you have rushed out and confronted the said person?.I bet you a weeks wage's that he was a chancer showing off and he deserved what he got

Quite right, I would doubt very much if I would have been in your words so understanding, if said event actually happened on my property (most probably would have put a red hot poker up his jacksee). That said, it's like health and safety, I don't take things at face value or how they first appear on the surface. I always try to look in to the root causes and underlying causes of things as should any good CWU health and safety rep when carrying out accident investigations (not suggesting that this was an accident).

I am sure that I also said on the face of it a disgusting action and I do not retract one iota from that sentence a deplorable thing to do. I also made the suggestion that the employee concerned could have been suffering from an overactive bladder which is a possibility and for others to give this consideration.

As to your other suggestion of betting a weeks wage's that he was a chancer showing off and he deserved what he got. You may unlike myself have further inside information on this one, I simply couldn't afford to wager half-a-days pay on what we get paid by RM.

If indeed that it transpires that he was a show off and chancer, then quite rightly by his actions, and as a result of his actions, then he has nobody to blame but himself for his own downfall (or in H&S language) 100% contributory negligent. As you are a knowledgeable person DB1100 I always look and will continue to look forward to your postings regardless of whether we are in agreement or not. It seems a little harsh, it might not be recommended but if he was out in the country doing the same against a tree. A lot of people would turn a blind eye.

I agree lifesentence,but that is a totally different matter,in the first instance he urinated against some ones property and it would be reasonable to assume there was adequate toilet facilities nearby,out in the country up against a tree is perfectly acceptable because there would be no toilet nearby.
