Can anyone tell me whether local agreements have to be adhered to by Royal Mail management or if they are at liberty to disregard them when it suits them ?

Local Agreements should be adhered to by Royal Mail management as should national agreements :Very Happy If they dont then there is a good chance unrest may prevaile amongst the workforce which could result in anything up to and including strike action. :whistle

Thanks Johnny. My OH has just lost his appeal against dismissal because he was informed that management didn't have to adhere to a local agreement regarding AOD because it was not official Royal Mail policy.

Was this appeal a royalmail cover up!. I say this as you still have the right to an employment tribunal go see your rep or an employment solicitor and good luck to both of you!.

IMO , I wouldn't bother with appeals - the orders from on high is to not undermine local management and it will and it must be 60/40 % FT-PT .

The problem is if you did that , you'd be branded as a trigger - happy troublemaker :left: for not going through that rank closing sham .

Unless RM can prove negligence and they've been known to pull stunts - Detriment for H & S issues is a serious offence punishable in ET's .

I get the impression that RM play the percentage game in the hope that people are that sick and worn down by it all and don't give RM any trouble , though I think these stitch ups are to teach people a lesson for giving RM a H&S problem - it's all based on bullying , they've always been autocratic & regarded themselves above the law but there's a long line of cause and effect with :lfo & :cfo in charge now .

It certainly was K9. We are waiting for the CWU now to decide whether we have a strong enough case to go to tribunal at the moment.

The only trouble is you have to exhaust the internal procedures (including appeal) before you can lawfully go to a Tribunal

I agree , RM know this - as far as they are concerned they are not undermining local managers by closing ranks - it's all to spin out time , be obstructive and unnecessarily hostile and defensive .

The problem is despite this ruthless commercializm , RM still have a management structure that runs for the benefit of the managers inside it instead of trying to run a business . Their Senior & Area Managers have to be fed with what they want to hear in the "Alice in Wonderland " RM world .

Usual story when you go commercial , the worst of the two cultures :lfo :cfo

At one time you didn't get all this nonsense , the Union eventually got people back after some time after dodgy stitch ups , the CWU got their propaganda and the unfortunate posties got their back pay for RM's instuitionalized stupidity .

It meant local managers being thrown to the wolves in Independent appeals but RM then realized they might not get fed with what they wanted to hear :d'oh! :d'oh! :d'oh! :Very Happy

Also they seem to hope that people are that sick and tired of RM that they won't give them any problems , a form of bullying to wear people down . If that doesn't work they've always got their lawyers to get them out of the corner they bloody -mindedly insist on backing themselves into . :no no :no no  :evil/mad
