It was a motoring offence and we were just witnesses, so we were told it may happen but we weren't consulted on it.

It might be, because it was a different kind of offence. But I still think that they should have taken the trouble to get your opinion, considering you'd gone to the trouble of turning up.

It was a Criminal Case which I had to go to.

Some more information - It now appears that the driver (who also works in my DO) has no insurance (he also uses his car for delivery sometimes)

Did he have no Insurance at all, or did he invalidate it by using his Car for deliveries?
If he had no Insurance at all, then he doesn't deserve to be sharing the Roads with the rest of us.

If he invalidated it. Then why wasn't he covered by RM's Insurance?

If it was a failing of the DOM: then he/she should be severely disciplined for putting one of our Collegues in that situation in the first place!
