Section 4 probably may not apply as this is protection on strike days and is designed to stop all strikers being arrested and or investigated when there is an Official Dispute. This would not be used in defence of a strike breaker who gets caught delaying mail on a strike day, and it also does not apply on any other days other than the recognised strike days or when any other form of authorised and legal IA is used.
Unfortunately this is also the sub section that the IB and RM management can use against wild cat strikes if they decide to go down that route. Although using the act at such a time would be an extremely bold move and would not be done without Prime Ministerial approval in my estimation.

UNEXCUSED DELAY TO MAIL
The responsibility for safeguarding the mail and giving it prompt and accurate treatment is one of the most important duties of all employees.
Various actions can cause mail to be delayed, e.g. carelessness, negligence, breach or disregard of a rule or guideline. Such instances are to be distinguished from wilful delay although they may also be treated as misconduct, and in more serious instances could also result in dismissal.
Furthermore, Royal Mail does recognise that genuine mistakes and misunderstandings do occur and it is not the intention of the Business that such cases should be dealt with under the Conduct Code beyond counselling for the isolated instance. The key is that employees should do their job to the best of their ability and, if in doubt, ask for their manager's advice and guidance.
WILFUL DELAY
Wilful delay of mail is classed as gross misconduct, which if proven could lead to dismissal. The test to determine whether actions may be considered as wilful delay is as follows:
Deliberate action taken by an employee that causes mail to be delayed is called wilful delay. Where proven, such breaches of conduct can lead to dismissal, even for a first offence; indeed Wilful Delay is a criminal offence and can result in prosecution.

What RM should be doing is providing a structure for Saturdays. Our office shuts at 2pm when the mailcentre driver returns to base. The place is all locked up. The PO's are shut at 12.30pm. We need some guidance as to what we should do if we are late back and we have mail/specials to return. It is all very well RM accusing someone of taking mail home but they should at least have some alternatives that we should use so that we do not get into the same bother as MRX has.
Good luck to MRX. At least he is standing up and proving RM are the incompetent ones in this matter.

I cant say when or where this is taking place , what i will say is that things have moved on quickly and significant breakthroughs may give reason to post an update shortly.....HOWEVER PLEASE REMEMBER THAT NOT ALL DETAILS POSTED ARE THE CORRECT STORY ,THINGS TIMES AND SOME SITUATIONS HAVE BEEN CHANGED BUT THE OUTLINE IS EXACT....
