TRIBUNAL UPDATE APR 2008

Hi all , heres the story so far:
Ex Pt postie is charged with wilful delay,postie denies allegations,postie investigated by IB is caught with left over mail,missorts and mail that he does not deliver outside the boudaries of his contract in other words he is part time on four hours a day and doesnt complete (not everyday) manager deters him from claiming OT (like thay all do) so he refuses to work out of courtesy to finish the mail round(not every day)
He is suspended then called to a meeting to answer why he shouldnt be sacked outright they alledge theft(not the case and subsequently that allegation dropped after this event)
Postie quits before they sack him for wilful delay and alledged theft of mail.
Posie then is NOT charged with theft therefore starts proceedings of a tribunal against the RM for constructive dimissal( this is not whne you are sacked but when you quit your job based on your employers actions)
Postie claims he was following the proceedures given to him by his superiors.
This far the RM HAVE NOT responded to a lawful claim and have one day left before a default judgement is issued on them,which means that at any tribunal hearing (this will happen) they cannot represent themselves as they have not (so far)responded to the claimant.
Claimant(ex postie) secretly videoed his bosses in certain situations regarding OT /etc.


The conversation has been aired for two days now and now removed under the advice of MRX for whom im working for.
MRX thanks those whom replied with advice and I WILL UPDATE FROM WED9TH APRIL 2008

best leaving that to a Solicitor , RM have ways of whitewashing or making things "look straight ".

so basically what we have here is another bloody lying pig of a manager who can't get to grips with the simple reality of a job. Treat us decent and we work harder, treat us bad then why should we work harder.

Leighton said on radio 2 a few years back, a decent pay for decent work, he LIED, It then came out that WE the postmen / postwomen are underworked and overpaid. This is coming from a guy who is basically a bloody moron.

I hope he wins his tribunal, in fact I have been toying with that idea myself for discrimination in the workplace.

Well said and i wholly agree after haveing dealing's with a lying pig of an excuse of a manager to day they can't see the light for their head is so far up the DOM's rectum.

Its about time they all realise that if it wasn't for the fact we are breaking our backs to do the job then they wouldn't have a job nor have the time to play space invaders nor play let be morons with eachother.

Its not surprising that many people, esp those with good service and long service are fed up to the teeth with being shafted and wanting to leave.

They can get all the pt staff they want, one day they will all realise whats it like to be on the dole, karma works

I'm just wondering where the problem is!

From the portion of the transcript posted, the way I see it is:

Mr X has commitments and states that he cannot work past 1.00 PM but often goes over by 45 mins. (quarter to two)
Mr C offers to have his walk banded for him, (thus shaving around 15 mins of his time); then allows him to start earlier and claim the additional 30 mins if required in overtime. He would still be finished before the time which would impact on his 'other work'. In addition to this offer, Mr C also tells Mr X that if he is unable to complete within his allotted hours and wishes not to work overtime, then to let him know, (as per procedure).

Bearing also in mind that walks are supposed to be 3 hours 30 mins long anyhow, (and the walk he's currently on is an easy one), Mr C has done nothing other than offer a positive solution to Mr X's problem. If not please explain to me what Mr C has done wrong, because I just don't see it!

Just be careful posting before the case is over. The guys own solicitors would advise him to stay quiet until the case is over!!!

Today, our H&S Rep was told to delete a Video of a dangerous load, because no-one is allowed to Video ANYTHING on RM Premises. Aparently, Photos are fine, but Videoing anything on the Premises can, and will be treated as a disciplinary matter!

Luckily, our Rep was let off, as he wasn't aware of this, and deleted the Video in front of the manager.

You should warn your friend to be very careful, as they will probably try to get the Judge to rule that the Video is inadmissable.

Also, please bear in mind what Lovejoy said about Posting before the case is over. This Forum is available to the Public, and you could screw up the whole case if you're not careful.

I know that it is important that we know about cases like this, but it's better to wait until it's all over, and tell us about it then. The managers are very crafty. They wouldn't think twice about using anything that they think will help their case from your Posts.

A Manager on AL filmed a guard in the driver's cab , the RMT got that guard back as video evidence was inadmissible , there was a lot of that underhand stuff going on to deliberately create a culture of fear .

DO NOT underestimate RM !, yes certain managers and the culture can seem thick and arrogant but even those thick managers are well advised by their superiors , everything will be twisted round or twisted on it's head , no matter how vague or obscure, FINE if you can contradict and challenge it , if RM are trying to be too clever by half or devious to the point of being neurotic ;otherwise discretion is the better part of valor .

RM are hardly going to let people tell tales out of class, and put the white flag up .

That's best left to a Employment Solicitor, HE/SHE will prosecute / nail RM .

When evidence was provided by MRX for his employment solicitor regarding the "goings on" at the office MRX was operating out of, the solicitors first reaction was "Jesus"...........
Some of the video stuff is quite unreal.
When it is safe to do so MRX will allow me to post on his behalf links to all video and transcripts of conversations he had with scheming managers etc..but not yet ,MRX wants to expose the RM for what it is and that the buisness is corrupt from top to bottom ,its management inept and poorly trained,only interested in meeting impossible targets through whatever means...He says it will be made public and would encourage all posties to cover thier backs the same way he did..if you ask me,sound advice

MRX informs that section 4 has amassive influence also on this case as he was arrested at the times of the strike.Section 4 deals with the delay of mail whilst there is a trade dispute of which MRx was a supporter.....
