Unauthorised absence & Special leave

If an OPG has numerous Unauthorised absences or Special leave (both unpaid) for various personal reasons, can they be considered for Conduct due to the amount of absences?

This has happened in an office where an OPG has been invited to a Fact Finding meeting due to the high level of absences (unpaid) over the last year.

Some sick leave now tho is unpaid so would that mean you can’t be conducted for that?

Nothing stopping you being subjected to the attendance procedure for authorised/unauthorised or sick absense, be that paid or unpaid.

But people should not be judging any absence of a coleague, whatever the reason.

Paid or unpaid an absence is an absence! I made that mistake way back when I started and thought as I wasn't being paid any sick pay for the first year it didn't matter as it didn't cost the company anything.... and turns out it did matter! :roll:

Unless the unauthorised absences are covered by the Equality Act, they are just unauthorised absences so yes, they can take you in for a fact finding meeting to see what you have to say and then take you down the conduct route if there is no adequate explanation.

Got told even EA dsnt cover staff under new procedure ?

The EA & DA are there to put disadvantaged employees LEVEL with able bodied employees.

They are still subject to the same rules and conduct regs. (They may get some abscences dicounted but if the abscences are superflous then they will get run the same as everyome else)

Hi
I have a related issue..
I have a BH day in lieu for which they have refused to allow me to take on a day of my choosing, claiming they have too many people off.
If I was to tell them I am taking it anyway, will they conduct me despite its leave I am entitled to. If they did conduct me could it result in the sack or just a warning. I assume if they conduct me then I would still have the day in lieu available.

Yes they will likely conduct you if you take a day off that they have already told you is unavailable. Whether you get the sack depends on your previous record.

Try asking the other people who are off that day if they would swap a day off with you instead?

What makes you think you are entitled to demand and take a day off of your own choosing?
Does it say that in any agreement or your contract of employmnent?

They will only offer a day off that week if it is available an if you say they have too many off then they wont allow it.would say a massive risk if you go ahead an take it.prob do you with going AWOL.

Not sure where you are getting it being a massive risk from pal?? You are making it out like the guy is a criminal or something, which they clearly aren't
